Regular Session, 2012 ENROLLED SENATE BILL NO. 396 BY SENATOR CROWE AN ACT1 To amend and reenact R.S. 34:3494(A), (B)(3), and (D), to enact R.S. 34:3499(A)(10), and2 to repeal R.S. 34:3494(B)(9), relative to the Louisiana International Gulf Transfer3 and Terminal Authority; to provide for changes in the board membership; to provide4 for powers of the authority; to provide for the payment of certain expenses; and to5 provide for related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. R.S. 34:3494(A), (B)(3), and (D) are hereby amended and reenacted and8 R.S. 34:3499(A)(10) is hereby enacted to read as follows: 9 §3494. Board of commissioners; qualifications; term; vacancies; compensation10 A. The authority shall be governed by a board of sixteen fifteen11 commissioners, consisting of the secretary of the Department of Economic12 Development and the secretary of the Department of Transportation and13 Development, the chairmen of the House and Senate committees on transportation,14 highways, and public works or their designees and twelve eleven commissioners15 appointed by the governor to be chosen on the basis of their demonstrated experience16 in maritime or business leadership, or both, and their stature and ability to act17 effectively for the best interests of Louisiana. Such commissioners shall not be18 appointed or elected commissioners or board members of any other Louisiana port.19 B. Commissioners shall be chosen as follows:20 * * *21 (3) One member shall be selected from a list of three nominees submitted by22 the New Orleans Steamship Louisiana Maritime Association.23 * * *24 D. Powers3 A. The authority shall be empowered to do any and all things necessary or4 proper to carry out the purposes of this Chapter, including but not limited to the5 following:6 * * *7 (10) To accept and use any gift, grant, donation, or otherwise any sum8 of money, or property, aid or assistance from the United States, the state of9 Louisiana, or any political subdivision thereof, or any person or legal entity for10 purposes consistent with responsibilities and functions of the authority.11 * * *12 Section 2. R.S. 34:3494(B)(9) is hereby repealed.13 Section 3. The terms of the members serving on the effective date of this Act as14 commissioners who were selected from the lists submitted by the Mississippi River15 Maritime Association and the New Orleans Steamship Association shall terminate as of the16 effective date of this Act.17 Section 4. This Act shall become effective upon signature by the governor or, if not18 signed by the governor, upon expiration of the time for bills to become law without signature19 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.
