AN ACT1
To amend and reenact R.S. 38:2211(A)(12), relative to public contracts; to provide relative2
to letting contracts for public works; and to provide for related matters.3
Be it enacted by the Legislature of Louisiana:4
Section 1. R.S. 38:2211(A)(12) is hereby amended and reenacted to read as follows:5
ยง2211. Definitions6
A. As used in this Chapter unless the context clearly indicates otherwise, the7
following terms shall mean:8

(12) "Public work" means the operation, erection, construction, alteration,10
improvement, or repair of any public facility or immovable property owned, used,11
or leased by a public entity.12

DIGEST
Present law provides certain requirements for letting contracts for public works.
Present law provides that "public work" means the operation, erection, construction,
alteration, improvement, or repair of any public facility or immovable property owned, used,
or leased by a public entity.
Proposed law removes "operation" of any public facility or immovable property owned,
used, or leased by a public entity from the definition of public work.
Effective August 1, 2012.
