AN ACT1
To amend and reenact R.S. 33:4080(A), relative to the sewerage system in the city of New2
Orleans; to provide for the shifting of high voltage electric lines and certain wires,3
at the owner's expense, to accommodate public system projects; and to provide for4
related matters.5
Notice of intention to introduce this Act has been published.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 33:4080(A) is hereby amended and reenacted to read as follows: 8
ยง4080.  Shifting private mains to accommodate public system9
A. Any person who has laid mains, pipes, or conduits, high voltage electric10
lines, telecommunication, fiber optic, or other transmission wires, or constructed11
any railroads, buildings, works, or structures of any kind in, on, or over the public12
streets, roads, drainage systems or canals, sewerage systems, or water systems may13
be compelled at his own cost and expense to shift or adjust any such mains, pipes,14
conduits, high voltage electric lines, telecommunication, fiber optic, or other15
transmission wires, or structures to the exigencies of the public sewerage and public16

Present law provides that, for properties within Orleans Parish and under the jurisdiction of
the New Orleans Sewerage and Water Board, an owner may be compelled at their own cost
and expense to shift or adjust structures they have laid or constructed in, on, or over the
public streets, roads, drainage systems or canals, sewerage systems, or water systems relative
to the public sewerage, water or drainage systems. Such structure may be any of the
following:
1. Mains
2. Pipes
3. Conduits
4. Railroads
5. Buildings
6. Works
7. Any other kind of structure.
Proposed law expands the above list of structures by adding the following:
1. High voltage electric lines
2. Telecommunication, fiber optic or other transmission wires.
Effective August 1, 2012.
