Regular Session, 2012 SENATE BILL NO. 435 BY SENATOR BROOME COMMERCIAL REGULATIONS. Requires National Human Trafficking Resource Center hotline information to be posted at certain establishments, truck stops, and rest stops. (8/1/12) AN ACT1 To enact R.S. 15:541.1, relative to human trafficking; to provide that certain establishments2 shall post information regarding the National Human Trafficking Resource Center3 hotline; to provide for the form and content of the posting; to provide for languages4 in which the information is to be posted; to provide for certain departments to notify5 affected establishments of the requirements; to provide for a civil penalty; and to6 provide for related matters.7 Be it enacted by the Legislature of Louisiana:8 Section 1. R.S. 15:541.1 is hereby enacted to read as follows: 9 ยง541.1. Posting of the National Human Trafficking Resource Center hotline;10 content; languages; notice; civil penalty11 A. All of the following establishments shall be required to post12 information regarding the National Human Trafficking Resource Center13 hotline:14 (1) Every massage parlor, spa, or hotel that has been found to be a15 public nuisance for prostitution as set forth in R.S. 13:4711.16 (2) Every strip club or other sexually-oriented business as set forth in17 SB NO. 435 SLS 12RS-839 ORIGINAL Page 2 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. R.S. 37:3558(C).1 (3) Every highway truck stop or highway rest stop.2 B. (1) Such information shall be posted prominently both inside and3 outside the premises described in Subsection A of this Section.4 (2) Such posting shall be no smaller than eight and one-half inches by5 eleven inches and shall contain the following wording:6 "If you or someone you know is being forced to engage in any activity7 and cannot leave, whether it is commercial sex, housework, farm work, or any8 other activity, call the National Human Trafficking Resource Center hotline at9 1-888-373-7888 to access help and services.10 The victims of human trafficking are protected under U.S. law and the11 laws of Louisiana.12 The hotline consists of the following services:13 (a) Available 24 hours a day, 7 days a week.14 (b) Toll-free.15 (c) Operated by a non-profit, non-governmental organization.16 (d) Anonymous and confidential.17 (e) Accessible in 170 languages.18 (f) Able to provide help, referral to services, training, and general19 information".20 (3) The posting shall be printed in English, Spanish, and any other21 languages that the Department of Public Safety and Corrections shall require.22 C. The following departments of the state shall provide each23 establishment described in Subsection A of this Section which is under the24 jurisdiction of one of the following agencies or departments with notice of this25 Section. The agencies and departments shall post on their websites a sample of26 the posting described in Subsection B of this Section which shall be accessible27 for download. (2) Department of Transportation and Development.1 (3) The Louisiana Workforce Commission.2 D. A civil penalty of five hundred dollars shall be assessed for each3 violation of this Section. The agencies and departments listed in Subsection C4 of this Section are charged with the enforcement of this Section and may assess5 the civil penalty.6 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Mary Dozier O'Brien. DIGEST Proposed law provides that certain massage parlors, spas, and hotels, as well as every strip club, sexually-oriented business, highway truck stop, and highway rest stop shall display a posting alerting citizens to the assistance of the National Human Trafficking Resource Center (NHTRC) hotline. Proposed law provides for the wording of the posting and for the minimum size of such posting. Proposed law provides that such posting shall be in English and Spanish, as well as any other language mandated by the Dept. of Public Safety and Corrections. Proposed law provides that the Dept. of Public Safety and Corrections, the Dept. of Transportation and Development and the Louisiana Workforce Commission shall enforce these provisions. Proposed law provides for a civil penalty of $500 to be assessed by the appropriate state department or agency. Effective August 1, 2012. (Adds R.S. 15:541.1)
