COMMERCIAL REGULATIONS. Requires National Human Trafficking Resource Center
hotline information to be posted at certain establishments, truck stops, and rest stops.

AN ACT1
To enact R.S. 15:541.1, relative to human trafficking; to provide that certain establishments2
shall post information regarding the National Human Trafficking Resource Center3
hotline; to provide for the form and content of the posting; to provide for languages4
in which the information is to be posted; to provide for certain departments to notify5
affected establishments of the requirements; to provide for a civil penalty; and to6
provide for related matters.7
Be it enacted by the Legislature of Louisiana:8
Section 1.  R.S. 15:541.1 is hereby enacted to read as follows: 9
ยง541.1. Posting of the National Human Trafficking Resource Center hotline;10
content; languages; notice; civil penalty11
A. All of the following establishments shall be required to post12
information regarding the National Human Trafficking Resource Center13
hotline:14
(1) Every massage parlor, spa, or hotel that has been found to be a15
public nuisance for prostitution as set forth in R.S. 13:4711.16
(2) Every strip club or other sexually-oriented business as set forth in17 SB NO. 435

(3)  Every highway truck stop or highway rest stop.2
B. (1)  Such information shall be posted prominently both inside and3
outside the premises described in Subsection A of this Section.4
(2)  Such posting shall be no smaller than eight and one-half inches by5
eleven inches and shall contain the following wording in bold typed print of not6
less than fourteen-point font:7
"If you or someone you know is being forced to engage in any activity8
and cannot leave, whether it is commercial sex, housework, farm work, or any9
other activity, call the National Human Trafficking Resource Center hotline at10
1-888-373-7888 to access help and services.11
The victims of human trafficking are protected under U.S. law and the12
laws of Louisiana.13
The hotline consists of the following services:14
(a)  Available 24 hours a day, 7 days a week.15
(b)  Toll-free.16
(c)  Operated by a non-profit, non-governmental organization.17
(d)  Anonymous and confidential.18
(e)  Accessible in 170 languages.19
(f) Able to provide help, referral to services, training, and general20
information".21
(3) The posting shall be printed in English, Spanish, and any other22
languages that the Department of Public Safety and Corrections shall require.23
C. The following departments of the state shall provide each24
establishment described in Subsection A of this Section over which that25
department exercises any regulatory control or authority with the notice26
required by this Section. The departments shall post on their websites a sample27
of the posting described in Subsection B of this Section which shall be accessible28

(1)  Department of Revenue.1
(2)  Department of Transportation and Development.2
D. A civil penalty of five hundred dollars shall be assessed for each3
violation of this Section. The departments listed in Subsection C of this Section4
are charged with the enforcement of this Section and may assess the civil5
penalty.6

Proposed law provides that certain massage parlors, spas, and hotels, as well as every strip
club, sexually-oriented business, highway truck stop, and highway rest stop shall display a
posting alerting citizens to the assistance of the National Human Trafficking Resource
Center (NHTRC) hotline.
Proposed law provides for the wording of the posting and for the minimum size of such
posting and that the wording of such posting be in bold typed print of not less than 14 point
font.
Proposed law provides that such posting shall be in English and Spanish, as well as any other
language mandated by the Dept. of Public Safety and Corrections.
Proposed law requires the Dept. of Revenue and the Dept. of Transportation and
Development to notify the described establishments over which that department exercises
any regulatory authority, to post on their respective websites a sample of the posting, and to
enforce these provisions.
Proposed law provides for a civil penalty of $500 for each violation to be assessed by the
appropriate state department or agency.
Effective August 1, 2012.
