AN ACT1
To enact R.S. 51:940.1, relative to standards and procedures for the state Department of2
Economic Development or the office of entertainment industry development; to3
prohibit certain certifications by the Department of Economic Development or the4
office of entertainment industry development; to prohibit the approval of certain5
certifications; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1. R.S. 51:940.1 is hereby enacted to read as follows: 8
§940.1. Motion picture investor; prohibition on certification for pornographic9
materials10
A. Purpose. The purpose of this Section is to provide heightened11
standards and procedures by the Department of Economic Development or the12
office of entertainment industry development.13
B. The Department of Economic Development or the office of14
entertainment industry development shall not certify any film project which the15
production company must register pursuant to 18 U.S.C. §2257. Every motion16
picture production company applicant shall submit to the department or office,17 SB NO. 513

as applicable, a statement certifying that it is not required to maintain records1
pursuant to 18 U.S.C. §2257.2

Proposed law provides that the Department of Economic Development (DED) or the office
of entertainment industry development (the office) shall not certify any film project in which
the production company must register pursuant to federal criminal codes relative to the
production of certain film, books, magazines, or other materials which sexually exploit
children. Requires every motion picture production company applicant to submit to the
department or office, as applicable, a statement certifying that it is not required to maintain
records pursuant to the federal law.
Effective August 1, 2012.

1. Deletes applicability of the provisions relative to the expenditure of state
