(8/1/12) AN ACT1 To amend and reenact R.S. 33:180(B), relative to annexation of territory owned by a public2 body; to provide for the authority to exclude certain territory from annexation; and3 to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 33:180(B) is hereby amended and reenacted to read as follows: 6 ยง180. Ordinance to annex territory owned by a public body7 * * *8 B. No municipality may annex the paved portion of a public road without9 including in such annexation all property adjacent to at least one side of the road, the10 paved portion of which is included in the annexation. DIGEST Heitmeier (SB 524) Present law provides that no municipality may annex the paved portion of a public road without including in such annexation all property adjacent to at least one side of the road, the paved portion of which is included in the annexation. Proposed law retains present law and adds the department of transportation and development has the option of excluding from the annexation without the annexation being considered not contiguous, the paved portion of interstate highway right of way. Effective August 1, 2012. (Amends R.S. 33:108(B))
