PARISHES.  Provides for cleanup and removal of abandoned structures in certain parishes.

AN ACT1
To enact R.S. 33:1236(66), relative to certain powers of parishes; to provide for cleanup and2
removal requirements of abandoned structures by certain owners of land adjacent to3
certain lakes; to provide for terms, conditions, procedures, and definitions; and to4
provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 33:1236(66) is hereby enacted to read as follows: 7
ยง1236. Powers of parish governing authorities8
The police juries and other parish governing authorities shall have the9
following powers:10

(66)(a)  Abandoned, blighted or condemned structure is a man-made12
dwelling, building, or shelter located on land adjacent to or bordering on a lake.13
Such structures may also be piers, boats, and docks, both submerged or above14
the surface of the lake.15
(b) Man-made abandoned, blighted or condemned structures located16
adjacent or bordering a lake shall be removed at the owner's cost when ordered17 SB NO. 585

by the local governing authority.1
(c) Owners of such structures shall be given not less than thirty days to2
begin the removal of the abandoned, blighted or condemned structure or be3
subject to fines to be determined by the local governing authority.  Failure to4
begin removal of the abandoned, blighted or condemned structure within the5
thirty day period will allow the local governing authority to remove the6
structure or have the structure removed at the owner's costs.7
(d) Owners of such abandoned, blighted or condemned structures who8
refuse to remove such structures when ordered, shall be subject to liens being9
placed upon that property or any other property owned by such owners and10
located in that parish.11
(e) Any local governing authority where such abandoned, blighted or12
condemned structures are located, may after due process of law, seize and sell13
the property upon which the structure is located and place the proceeds of such14
sales into the general operating fund of the parish.15
(f) The provisions of this Paragraph shall apply to any parish with a16
population of not less than two hundred twenty-five thousand nor more than17
two hundred fifty thousand persons.18

Proposed law requires owners of abandoned, blighted or condemned structures to remove
them when ordered by a parish governing authority.
Proposed law provides that certain parish governing authorities may remove or have
removed at the cost of the owner any structures determined to be abandoned, blighted or
condemned if that owner fails to begin removal of the structures within 30 days of a removal
order.
Proposed law provides that certain local governing authorities may, after due process of law,
place liens upon the property upon which such structures are located when the owner of the
property refuses to remove the abandoned, blighted or condemned structures.
Proposed law provides that certain parish governing authorities may, after due process of
law, seize the property upon which the structures are located, sell the property and place the
proceeds in the general operating fund of the parish if a property owner refuses to cleanup
and remove the abandoned, blighted or condemned structure. SB NO. 585

Proposed law provides that the provision of proposed law will apply to parishes with a
certain population range.
Effective August 1, 2012.
