AN ACT1
To enact R.S. 49:663.3, relative to community development block grants and other federal2
hurricane recovery dollars; to provide for the office of community development; to3
provide for the allocation of certain funds; to provide for purpose; to provide for4
definitions; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 49:663.3 is hereby enacted to read as follows: 7
ยง663.3. Allocation of funding; office of community development8
A. Notwithstanding any other provisions of law to the contrary, the office9
of community development within the division of administration shall allocate10
and administer funds provided in whole or in part from the Federal Community11
Development Block Grant Program, or other federal funds provided for12
hurricane recovery, to the governing authority of a municipality.13
B.  As used in this Section:14
(1) "Office" means the office of community development within the15
division of administration.16
(2) "Governing authority" means the governing authority of a parish.17 SB NO. 587

(3) "CDBG proposal" means an Action Plan, a Partial Action Plan, an1
amendment or amendments to an Action Plan or a Partial Action Plan, or any2
other method utilized for the allocation of dollars for the use of Community3
Development Block Grant funds and other funds provided for the recovery.4
(4)  "Recovery" means all efforts and activities of the state and local5
municipalities to rebuild and redevelop from Hurricane Katrina and its6
aftermath, Hurricane Rita and its aftermath, Hurricane Ike and its aftermath7
and Hurricane Gustav and its aftermath.8
C.(1)(a) The office shall develop proposals related to the recovery,9
including CDBG proposals, Action Plans, Partial Action Plans, amendments to10
Action Plans or Partial Action Plans, or any other method utilized for the11
allocation of dollars for the use of Community Development Block Grant or12
other funds provided for the recovery, hereinafter the "proposal".  After13
developing a proposal, the office shall send the proposal to the governor for14
approval. If the governor approves the proposal, it shall be submitted to the15
Joint Legislative Committee on the Budget for review, amendment and16
approval. At the same time as the proposal is submitted to the Joint Legislative17
Committee on the Budget, the proposal shall be submitted for review to the18
appropriate oversight committees of the House of Representatives and the19
Senate which have jurisdiction over the type of matter which is the subject of20
the proposal.21
(b) If the appropriate oversight committee objects to the proposal, it22
shall so notify the Joint Legislative Committee on the Budget. Whenever any23
proposal amounts to ten million dollars or more and is approved by the Joint24
Legislative Committee on the Budget, the authority shall submit the proposal25
for approval of a majority of the elected members of each house of the26
legislature. If the legislature is in session, the approval shall be by resolution or27
act. If the legislature is not in session, approval shall be obtained using the same28
mail ballot procedure used to obtain such approval of action of the interim29 SB NO. 587

emergency board.1
(c) If a proposal is approved as provided by Subparagraphs (a) and (b)2
of this Paragraph, the governor shall submit the proposal to the appropriate3
federal authority for approval.4
(2) After the appropriate federal approval has been obtained, the office5
shall request the approval of the Joint Legislative Committee on the Budget for6
a budget adjustment in the amount of the approved funding in accordance with7
the procedures set forth in the General Appropriations Act and Title 39 of the8
Louisiana Revised Statutes of 1950.9
(3) The office shall establish a clear and effective process for10
implementation of action plans for the CDBG program, including but not11
limited to providing for the preparation and review of draft plans, fiscal12
management, reporting, technical support, and all other support activities13
necessary to administration and complying with any other federal or state14
requirements.15
D.(1) The office shall submit to the legislature for its approval by a16
majority of the elected members of each house of the legislature any proposals17
which it has developed related to recovery from the hurricanes which provide18
for expenditures of ten million dollars or more.19
(2) The office shall provide to each member of the legislature seven days20
before submitting for approval by a committee or by a house of the legislature21
any instrument which provides for expenditures of ten million dollars or more22
accurate detailed information explaining the following about the proposal:23
(a) For each type of proposed expenditure set forth in the proposal,24
detailed information showing how the total amount of expenditure was derived25
or estimated, including the types of goods, services, or contract work expected26
to be purchased with such expenditures.27
(b) If the amounts of the proposed expenditures are estimates, which28
amounts or other information were such estimates based upon and a specific29 SB NO. 587

designation of the sources of that information.1
(c) A listing of the governmental and nongovernmental, public and2
private beneficiaries of the proposed expenditures.3
(3) Such information shall include any work papers or other documents4
related to estimated expenditures received by the authority from any task force,5
subcommittee, consultant, or state department or agency utilized by the office6
in preparation of the proposal.7
(4) Any legislative instrument submitted for approval by the legislature8
shall contain a reference to such information provided to members of the9
legislature pursuant to this Subsection which shall become a part of such10
instrument and proposal by reference.11
Section 2. This Act shall become effective upon signature by the governor or, if not12
signed by the governor, upon expiration of the time for bills to become law without signature13
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If14
vetoed by the governor and subsequently approved by the legislature, this Act shall become15
effective on the day following such approval.16

Proposed law provides for the office of community development (office) within the division
of administration to allocate funds provided in whole or in part from the Federal Community
Development Block Grant Program or other federal funds provided for recovery, to the
governing authority of a municipality in the aftermath of hurricanes Katrina, Rita, Ike and
Gustav.
Proposed law defines the following terms:  "Office", "CDBG proposal", and "Recovery".
Proposed law requires the office to develop proposals related to the recovery, including
CDBG proposals. Such proposals will be sent to the governor for approval.  If approved by
the governor, the proposal will be submitted to the Joint Legislative Committee on Budget
(committee), and the appropriate legislative oversight committee which may notify the
committee if it objects to the proposal. Upon approval of the proposal by the committee, the
proposal will be submitted by the governor to the U.S. Department of Housing and Urban
Development or other appropriate federal agency.  Proposed law requires approval of the
committee for incorporation of any monies associated with such a proposal into the budget.
Effective upon signature of governor or lapse of time for gubernatorial action.
