Regular Session, 2012 ENROLLED SENATE BILL NO. 595 BY SENATOR CROWE AND REPRESENTATI VE STUART BISHOP AN ACT1 To enact R.S. 12:2.1 and 2.2 and R.S. 44:4.1(B)(37), relative to access of certain public2 records; to provide for the "Business Identity Theft Prevention Act"; to make3 confidential certain electronic mail addresses and short message service numbers;4 to provide for notifications; to provide relative to the duties of the secretary of state;5 and to provide for related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. This Act shall be known and may be cited as "The Business Identity Theft8 Prevention Act".9 Section 2. R.S. 12:2.1 and 2.2 are hereby enacted to read as follows: 10 §2.1. Electronic mail addresses and short message service numbers;11 confidentiality12 Any electronic mail address or short message service number submitted13 to or captured by the secretary of state pursuant to the provisions of this Title14 shall be confidential and shall not be disclosed by the secretary of state or any15 employee or official of the Department of State.16 §2.2. Electronic notification of status changes17 The secretary of state shall notify any person who subscribes to the18 secretary of state's electronic mail or short message notification service and who19 is an officer of a corporation, member or manager of a limited liability20 company, or partner in a partnership, or any agent thereof, when a filing has21 occurred that may have removed that person's name from documents and22 records of that entity held by the secretary of state.23 Section 3. R.S. 44:4.1(B)(37) is hereby enacted to read as follows:24 §4.1. The legislature further recognizes that there exist exceptions, exemptions,1 and limitations to the laws pertaining to public records throughout the revised2 statutes and codes of this state. Therefore, the following exceptions, exemptions, and3 limitations are hereby continued in effect by incorporation into this Chapter by4 citation:5 * * *6 (37) R.S. 12:2.17 * * *8 Section 4.
