Regular Session, 2012 SENATE BILL NO. 621 BY SENATOR MURRAY CIVIL PROCEDURE. To provide relative to the Municipal Court of New Orleans. (8/1/12) AN ACT1 To amend and reenact R.S. 13:2497 and 2500.2(A)(1), to provide relative to courts and2 judicial procedures; to provide relative to the Municipal Court of New Orleans; to3 provide relative to certain court fees and salaries; to remove reference to specific4 dollar amounts of salaries for certain deputy clerks of the Municipal Court of New5 Orleans; to provide for an increase in certain fees collected by the Municipal Court6 of New Orleans; and to provide for related matters.7 Be it enacted by the Legislature of Louisiana:8 Section 1. R.S. 13:2497 and 2500.2(A)(1) are hereby amended and reenacted to read9 as follows:10 §2497. Deputy clerks; appointment; salaries; removal 11 The clerk of the municipal court of New Orleans shall appoint such deputies,12 assistants and employees as the legislature may provide. There shall not be less than13 twenty deputy clerks and other employees of the court, and their salaries and manner14 of appointment and removal shall be as hereinafter designated.15 The following named deputy clerks of the municipal court of New Orleans16 shall be appointed by the chief clerk of the court, who may remove any of them at17 SB NO. 621 SLS 12RS-951 REENGROSSED Page 2 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. any time, and their salaries are hereby fixed as follows: one chief deputy clerk at a1 monthly salary of three hundred dollars; four criers at a monthly salary of one2 hundred seventy-five dollars each; one deputy clerk, known as a bond clerk, at a3 monthly salary of one hundred seventy-five dollars; two deputy clerks, known as4 capias clerks, at a monthly salary of one hundred seventy-five dollars each; three5 deputy clerks, known as docket clerks, at a monthly salary of one hundred6 seventy-five dollars each; one deputy clerk, who shall do the stenographic work of7 the clerk's office, at a monthly salary of one hundred seventy-five dollars; one deputy8 clerk, known as cashier, at a monthly salary of one hundred seventy-five dollars; one9 deputy clerk, known as dock man in charge of the prisoners, at a monthly salary of10 one hundred seventy-five dollars; one deputy clerk, known as parole clerk, at a11 monthly salary of one hundred seventy-five dollars.12 All salaries of the clerks and deputy clerks of the municipal court of New13 Orleans shall be paid by the city of New Orleans.14 * * *15 §2500.2. Additional court costs to defray expenses16 A.(1) In all cases over which the Municipal Court of New Orleans has17 jurisdiction, there shall be taxed assessed as costs against every defendant who is18 convicted after trial or after he pleads guilty or who forfeits his bond a nonrefundable19 sum of fifteen thirty dollars, which shall be in addition to all other fines, costs, or20 forfeitures lawfully imposed.21 * * *22 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Julie J. Specifies position titles and monthly salaries of various deputy clerks in the Municipal Court of New Orleans. Proposed law removes references to specific salaries and retains present law requiring that there shall not be less than 20 deputy clerks and other employees of the Municipal Court of New Orleans, and that all salaries of the clerks and deputy clerks of the Municipal Court of New Orleans shall be paid by the city of New Orleans. Present law provides that in Municipal Court of New Orleans cases in which a defendant is convicted after trial or after he pleads guilty or who forfeits his bond, the Municipal Court of New Orleans shall tax as costs a nonrefundable sum of $15, which shall be in addition to all other fines, costs or forfeitures lawfully imposed. Proposed law provides that in cases of their jurisdiction, the Municipal Court of New Orleans shall assess costs against defendant convicted after trial or after he pleads guilty or who forfeits his bond. Proposed law increases the sum the defendant shall pay from $15 to $30. Effective August 1, 2012. (Amends R.S. 13:2497 and 2500.2(A)(1)) Summary of Amendments Adopted by Senate Committee Amendments Proposed by Senate Committee on Judiciary A to the original bill. 1.
