MOTOR VEHICLES.  Provides relative to driver education.(8/1/12)
AN ACT1
To amend and reenact R.S. 32:402.1(A)(1)(a) and the introductory paragraph of2
402.1(A)(2), relative to driver education; to provide relative to the requirements for3
driver education for persons who are less than eighteen years of age and for persons4
who are eighteen years of age or older; to provide relative to classroom instruction5
and actual driving instruction; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1. R.S. 32:402.1(A)(1)(a) and the introductory paragraph of 402.1(A)(2) are8
hereby amended and reenacted to read as follows: 9
ยง402.1. Driver education; required10
A. No application for a license for the operation of a motor vehicle shall be11
received from any person making application for the first time unless there is also12
submitted with the application, on a form approved by the secretary of the13
Department of Public Safety and Corrections, public safety services, written14
evidence of the successful completion by the applicant of one of the following:15
(1)(a) A "driver education course" for minors any person under the age of16
seventeen eighteen, which shall consist of not less than eight hours of actual driving17 SB NO. 667

instruction and thirty hours of classroom instruction. The Department of Public1
Safety and Corrections, public safety services, shall establish rules and regulations2
to administer and define the requirements of the course. The rules and regulations3
established by the Department of Public Safety and Corrections, public safety4
services, shall provide for instruction relative to the economic effects of littering.5
Oversight review of these rules shall be conducted by the House and Senate6
committees on transportation, highways and public works in accordance with the7
Administrative Procedure Act.8

(2) A "prelicensing training course" from any person 	seventeen eighteen10
years or older if a driver education course is not completed. The prelicensing training11
course shall consist of a minimum of six hours of classroom instruction and a12
minimum of eight hours of actual driving instruction. The Department of Public13
Safety and Corrections, public safety services, shall establish rules and regulations14
to administer and define the requirements of the course. Oversight review of these15
rules shall be conducted by the House and Senate committees on transportation,16
highways and public works in accordance with the Administrative Procedure Act.17

Present law requires a first time applicant for a drivers license who is a minor under the age
of 17 to present evidence of completion of a driver education course which consists of not
less than 8 hours of actual driving instruction and 30 hours of classroom instruction and
includes instruction relative to the economic effects of littering.
Proposed law changes present law to require driver education for applicants who are persons
under the age of 18.

has not completed a driver education course to complete a prelicensing training course which
