AN ACT1
To amend and reenact R.S. 32:402.1(A)(1)(a) and the introductory paragraph of2
402.1(A)(2), relative to driver education; to provide relative to the requirements for3
driver education for persons who are less than eighteen years of age and for persons4
who are eighteen years of age or older; to provide relative to classroom instruction5
and actual driving instruction; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1. R.S. 32:402.1(A)(1)(a) and the introductory paragraph of 402.1(A)(2) are8
hereby amended and reenacted to read as follows: 9
ยง402.1. Driver education; required10
A. No application for a license for the operation of a motor vehicle shall be11
received from any person making application for the first time unless there is also12
submitted with the application, on a form approved by the secretary of the13
Department of Public Safety and Corrections, public safety services, written14
evidence of the successful completion by the applicant of one of the following:15
(1)(a) A "driver education course" for minors any person under the age of16
seventeen eighteen, which shall consist of not less than eight hours of actual driving17
instruction and thirty hours of classroom instruction. A person shall not be allowed18
to receive more than four hours of actual driving instruction on any single19
calendar day. The Department of Public Safety and Corrections, public safety20
services, shall establish rules and regulations to administer and define the21
requirements of the course. The rules and regulations established by the Department22
of Public Safety and Corrections, public safety services, shall provide for instruction23
relative to the economic effects of littering. Oversight review of these rules shall be24

conducted by the House and Senate committees on transportation, highways and1
public works in accordance with the Administrative Procedure Act.2

(2) A "prelicensing training course" from any person 	seventeen eighteen4
years or older if a driver education course is not completed. The prelicensing training5
course shall consist of a minimum of six hours of classroom instruction and a6
minimum of eight hours of actual driving instruction. A person shall not be7
allowed to receive more than four hours of actual driving instruction on any8
single calendar day. The Department of Public Safety and Corrections, public safety9
services, shall establish rules and regulations to administer and define the10
requirements of the course. Oversight review of these rules shall be conducted by the11
House and Senate committees on transportation, highways and public works in12
accordance with the Administrative Procedure Act. The rules shall provide for:13
