PUBLIC RECORDS. Excepts certain records obtained by the Senate for the purpose of
confirmation from the provisions of public records law. (8/1/12)
AN ACT1
To amend and reenact R.S. 44:2, relative to public records; to exempt certain records2
obtained by the Senate for the purpose of confirmation from the public records law;3
and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 44:2 is hereby amended and reenacted to read as follows: 6
ยง2.  Records involved in legislative investigations7
A. (1) Subject to the proviso provisions set forth in Sub-section B of R.S.8
44:3(B), the provisions of this Chapter shall not apply to any records, writings,9
accounts, letters, letter books, photographs or copies thereof, in the custody or10
control of any attorney or counsel whose duties or functions are performed by or11
under the authority of the legislature and which concern or hold relation to any case,12
cause, charge or investigation being conducted by or through the legislature, until13
after the case, cause, charge or investigation has been finally disposed of. 14
(2) After final disposition, the records, writings, accounts, letters, letter15
books, photographs or copies thereof, are public records and subject to the provisions16

B.  Notwithstanding the provisions of Subsection A of this Section, the1
provisions of this Chapter shall not apply to any confidential data or records in2
the custody of the Senate which are obtained or used for the purpose of3
considering confirmation or approving or confirming any appointment for4
which Senate confirmation or approval is required.5

Present law provides for a general exception to the public records law for records involved
in legislative investigations.
Proposed law retains present law and provides for a specific exception to the public records
law for any confidential data or records in the custody of the Senate which are obtained or
used for the purpose of considering confirmation or approving or confirming any
appointment for which Senate confirmation or approval is required.
Effective August 1, 2012.
