Excepts certain records obtained by the Senate for the purpose of election, confirmation, or approval from the provisions of public records law. (8/1/12) AN ACT1 To amend and reenact R.S. 44:2, relative to public records; to exempt certain records2 obtained by the Senate for the purpose of confirmation from the public records law;3 and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 44:2 is hereby amended and reenacted to read as follows: 6 ยง2. Records involved in legislative investigations7 A. (1) Subject to the proviso provisions set forth in Sub-section B of R.S.8 44:3(B), the provisions of this Chapter shall not apply to any records, writings,9 accounts, letters, letter books, photographs or copies thereof, in the custody or10 control of any attorney or counsel whose duties or functions are performed by or11 under the authority of the legislature and which concern or hold relation to any case,12 cause, charge or investigation being conducted by or through the legislature, until13 after the case, cause, charge or investigation has been finally disposed of. 14 (2) After final disposition, the records, writings, accounts, letters, letter15 books, photographs or copies thereof, are public records and subject to the provisions16 of this Chapter.17 SB NO. 707 SLS 12RS-1785 REENGROSSED Page 2 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. B.(1) Notwithstanding the provisions of Subsection A of this Section, the1 provisions of this Chapter shall not apply to any privileged or confidential data2 or records in the custody of the Senate which are obtained or used for the3 purpose of considering the election, confirmation or approval of any nomination4 or appointment for which Senate election, confirmation, or approval is5 required.6 (2) Nothing in this Subsection shall prohibit the disclosure of any7 information relevant to the education, employment history, or work experience8 of an appointee or nominee.9 The original instrument was prepared by Lauren Bailey. DIGEST Amedee (SB 707) Present law provides for a general exception to the public records law for records involved in legislative investigations. Proposed law retains present law and provides for a specific exception to the public records law for any privileged or confidential data or records in the custody of the Senate which are obtained or used for the purpose of considering the election, confirmation, or approval of any nomination or appointment for which Senate election, confirmation, or approval is required. Proposed law allows the disclosure of any information relevant to the education, employment history, or work experience of an appointee or nominee. Effective August 1, 2012. (Amends R.S. 44:2) Summary of Amendments Adopted by Senate Senate Floor Amendments to engrossed bill 1. Makes technical change. 2. Adds privileged data or records to exceptions. 3. Changes the purpose of the data or records to the election, confirmation, or approval. 4. Provides that the disclosure of certain information is not prohibited.
