AN ACT1
To enact R.S. 11:413(11), relative to membership in the Louisiana State Employees'2
Retirement System; to provide for classes of employees who are ineligible for3
membership in the system; to provide for an effective date; and to provide for related4
matters.5
Notice of intention to introduce this Act has been published.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 11:413(11) is hereby enacted to read as follows: 8
ยง413. Classes of employees not eligible9
The following classes of employees and officers shall not be or become10
members of this system:11

(11) Any person who has previously served in the Louisiana Legislature.13

Section 2.  Any person to whom this Act applies who is an active contributing15
member of the Louisiana State Employees' Retirement System on June 30, 2012, may retain16
service credit accrued in the system; however, such person shall on and after July 1, 2012,17 SB NO. 727

be ineligible to be a member of the system.  Employer and employee contributions on the1
salary of all such persons shall cease, and no further service credit shall accrue after June 30,2
2012.3
Section 3. This Act shall become effective on June 30, 2012; if vetoed by the4
governor and subsequently approved by the legislature, this Act shall become effective on5
June 30, 2012, or on the day following such approval by the legislature, whichever is later.6

Claitor (SB 727)
Present law provides for membership in the Louisiana State Employees' Retirement System
(LASERS). Generally provides that persons who become employed in state service shall
become system members as a condition of their employment.
Proposed law retains present law.
Present law provides for classes of employees who are ineligible to become LASERS
members. Such classes include, among others, certain elected or appointed public officials
and independent contractors.
Proposed law retains present law and specifies that any person who has previously served
in the Louisiana Legislature is ineligible for LASERS membership.
Proposed law provides any person to whom proposed law applies who is an active
contributing member of LASERS on June 30, 2012, may retain service credit accrued in the
system. Provides, however, that such person shall on and after July 1, 2012, be ineligible
to be a member of the system. Further provides that employer and employee contributions
on the salary of all such persons shall cease, and no further service credit shall accrue after
June 30, 2012.
Effective June 30, 2012.
