SENATE BILL NO. 729
BY SENATOR CLAITOR 
ETHICS.  Provides for an exception to the prohibition of contractual agreements for any
contract with any plan providing medicaid services to medicaid recipients. (gov sig)
AN ACT1
To amend and reenact R.S. 42:1113(D)(2)(b), relative to the Code of Governmental Ethics;2
to provide for an exception to the prohibition of contractual arrangements for any3
contract with any plan providing medicaid services to medicaid recipients; and to4
provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 42:1113(D)(2)(b) is hereby amended and reenacted to read as7
follows: 8
ยง1113. Prohibited contractual arrangements; exceptions; reports9

(2) The provisions of this Subsection shall not prohibit the following:12

(b) A provider agreement entered into with the Department of Health and14
Hospitals under the state medical assistance program or a provider contract15
entered into with any plan providing medicaid services to medicaid recipients.16

Section 2. This Act shall become effective upon signature by the governor or, if not1
signed by the governor, upon expiration of the time for bills to become law without signature2
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If3
vetoed by the governor and subsequently approved by the legislature, this Act shall become4
effective on the day following such approval.5

DIGEST
Present law prohibits public servants, their immediate family members, or legal entities in
which they have a substantial economic interest, from entering into or being in any way
interested in any contract, subcontract, or other transaction that is under the supervision or
jurisdiction of the agency of such public servant.
Present law provides exceptions to the prohibition including a provider agreement entered
into with DHH under the state medical assistance program.
Proposed law retains present law and provides an exception for a provider contract entered
into with any plan providing medicaid services to medicaid recipients.
Effective upon signature of the governor or lapse of time for gubernatorial action.
(Amends R.S. 42:1113(D)(2)(b))
