ETHICS. Provides an exception to the provisions of law relative to ethical standards for
public servants. (8/1/12)
AN ACT1
To enact R.S. 42:1123(42), relative to the Code of Governmental Ethics; to provide for an2
exception to the provisions of law relative to ethical standards for public servants;3
to provide relative to a public servant doing business with a person who has a4
business relationship with the agency of the public servant under certain5
circumstances; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 42:1123(42) is hereby enacted to read as follows: 8
ยง1123. Exceptions9
This Part shall not preclude:10

(42) Notwithstanding any other provision of law in this Part, an12
individual who serves on a port commission, or a related family member, or an13
entity in which the member has a substantial economic interest to a grain14
elevator owned by a port commission may contract for the sale of grain15
provided:16

related to the management and operations of the grain elevator.1
(b) The terms and conditions of the sale are the same or substantially the2
same as a sale to a non-member.3

DIGEST
Present law prohibits a public servant or a legal entity in which he exercises control or has
an interest in excess of 25% from accepting anything of economic value, for services
rendered, from a person who has a business relationship with the agency of the public
servant.
Proposed law provides an exception to present law for an individual who serves on a port
commission, or a related family member, or an entity in which the member has a substantial
economic interest to a grain elevator owned by a port commission may contract for the sale
of grain if the member complies with R.S. 42:1120.4, including matters related to the
management and operations of the grain elevator and the terms and conditions of the sale are
the same or substantially the same as a sale to a non-member.
Effective August 1, 2012.
