AN ACT1
To enact R.S. 42:1123(42), relative to the Code of Governmental Ethics; to provide for an2
exception to allow members of the Greater Baton Rouge Port Commission and3
related persons to enter into certain transactions under the supervision and4
jurisdiction of the port under certain circumstances; and to provide for related5
matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 42:1123(42) is hereby enacted to read as follows: 8
ยง1123. Exceptions9
This Part shall not preclude:10

(42) A member of the Greater Baton Rouge Port Commission, an12
immediate family member of such a port commission member, or a legal entity13
in which such a port commission member or a member of his immediate family14
has a substantial economic interest from contracting for the sale of grain to the15
operator of a grain elevator that is owned, operated, or managed by the port16
commission provided that:17
(a) The port commission member recuses himself on all matters18
involving such sale of grain and all matters related to the management and19
operation of the grain elevator.20
(b) The terms and conditions of the sale are the same or substantially21
similar as a sale of grain by similarly situated persons who are not port22
commission members or related persons.23
Section 2.  This Act shall become effective upon signature by the governor24
or, if not signed by the governor, upon expiration of the time for bills to become law25 SB NO. 754	ENROLLED

without signature by the governor, as provided by Article III, Section 18 of the1
Constitution of Louisiana. If vetoed by the governor and subsequently approved by2
the legislature, this Act shall become effective on the day following such approval.3
