Regular Session, 2012 SENATE BILL NO. 83 BY SENATOR MURRAY HEALTH SERVICES. Provides relative to Polysomnographic Practice Act and individuals and practices exempted from its provisions. (8/1/12) AN ACT1 To enact R.S. 37:2869(A)(3), relative to the Polysomnographic Practice Act; to provide an2 additional exemption from the state licensure and permit requirement; and to provide3 for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 37:2869(A)(3) is hereby enacted to read as follows: 6 ยง2869. Individuals and practices not affected7 A. (b) The polysomnography procedures or services are performed under1 the direct supervision of a physician or a registered ploysomnographic2 technologist who is physically present in the area where such a3 polysomnography procedure or service is being performed and is available to4 furnish assistance and direction throughout the polysomnography procedure5 or service.6 * * *7 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Christopher D. Adams. DIGEST Present law provides a list of exemptions to the Polysomnographic Practice Act. Proposed law maintains present law and adds an additional exemption for an individual who is pursuing a course of study in an accredited CAAHEP polysomnographic technology education program, provided: (1)The procedure or service is part of the individual's course of study. (2)A physician or a registered ploysomnographic technologist is physically present for the procedure and available to provide assistance and direction. Effective August 1, 2012.
