ADMINISTRATIVE PROCEDURE.  Requires state agencies to provide notice upon
submission of certain reports to the legislature.  (1/1/13)
AN ACT1
To amend and reenact R.S. 49:968(D)(2)(a) and to enact R.S. 49:968(D)(1)(c), relative to2
the Administrative Procedure Act; to require agencies to provide written notice to3
the office of state register upon submission of certain reports to the legislature; to4
provide for an effective date; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 49:968(D)(2)(a) is hereby amended and reenacted and R.S.7
49:968(D)(1)(c) is hereby enacted to read as follows: 8

(c) The agency shall submit written notice to the Louisiana Register that12
the report required by Subparagraph (1)(b) of this Subsection has been13
delivered to the appropriate standing committee as provided for in Subsection14
B of this Section.  The Louisiana Register shall timely publish all such15
notifications electronically on a webpage.16
(2)(a) Except as provided in Paragraph H(2) of this Section, any17 SB NO. 88

subcommittee hearing on a proposed rule shall be held no earlier than five days and1
no later than thirty days following the day the report required by Subparagraph (1)(b)2
of this Subsection is received by the subcommittee or the day the notification is3
received by the Louisiana Register pursuant to Subparagraph (1)(c) of this4
Subsection if such notice is received by the Louisiana Register five or more days5
after the report is received by the subcommittee, whichever is later.6

Section 2.  This Act shall become effective on January 1, 2013.8

Proposed law requires that the agency submit to the Louisiana Register written notice that
a final report required by the Administrative Procedure Act has been submitted to the
appropriate standing committee of the legislature.
Present law provides that the legislative oversight period for rule making by an agency
begins no earlier than 5 days and no later than 30 days following the day the agency submits
the report to the appropriate standing committee.
Proposed law retains present law but adds that the oversight period begins either the day the
agency submits the report to the committee or the day the notification is received by the
Louisiana Register if such notice is received by the Louisiana Register five or more days
after the report is received by the subcommittee, whichever is later.
Effective January 1, 2013.
