AN ACT1
To amend and reenact R.S. 40:46(A), relative to filiation; to provide for new birth certificate2
after judgment of filiation; and to provide for related matters.3
Be it enacted by the Legislature of Louisiana:4
Section 1.  R.S. 40:46(A) is hereby amended and reenacted to read as follows: 5
ยง46.  Legitimation New certificate of birth when judgment of filiation is6
obtained7
A. If any child born in this state was legitimated by the subsequent marriage8
of its parents Upon request of a child who has obtained a judgment of filiation9
pursuant to Civil Code Article 197, the state registrar, upon receipt of a copy of the10
marriage certificate of the parents together with a notarized statement of the husband11
acknowledging the child's paternity judgment, shall prepare a new certificate of12
birth in the new name of the child wherein the child's surname shall be that of his the13
father recognized in the judgment or if both the father and mother agree, the14
surname may be the maiden name of the mother or a combination of the surname of15
the husband father recognized in the judgment and the maiden name of the mother.16
