Creates a committee to study statutes relative to inappropriate communications between school employees and minor students and to recommend further laws and requirements that should be implemented. A CONCURRENT RESOLUTI ON1 To create and provide with respect to a special committee to study and make2 recommendations with respect to statutes relative to inappropriate communication3 between school employees and minor students and to recommend to the Senate4 Judiciary B Committee what requirements for professional development, continuing5 education or pre-service training might be established relative to the professional,6 ethical, legal, and boundary rules governing inappropriate communication between7 school employees and minor students which should be enacted into law.8 WHEREAS, several current Louisiana statutes address the crime of prohibited9 communication between school employees and students; and10 WHEREAS, it is in the best interest of the citizens of Louisiana to protect minor11 children who attend any school or school institution within the state from inappropriate12 communication with school employees; and13 WHEREAS, it is the goal of the state to provide clear legal directives, professional14 development, and continuing education and training for all school employees who come into15 contact with minor students; and16 WHEREAS, it is in the best interest of public policy to prohibit inappropriate17 communication between school employees and minor students or cultivating an illicit18 SCR NO. 125 SLS 12RS-4326 ORIGINAL Page 2 of 3 relationship with a minor for the purpose of pursuing a relationship at the age of majority.1 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana hereby creates2 a special committee to study inappropriate communication between school employees and3 minor students and to recommend to the Senate Judiciary B Committee what requirements4 should be enacted into law to prohibit such inappropriate communication.5 BE IT FURTHER RESOLVED that the special committee created herein shall be6 composed of eleven members as follows:7 (1) A member of the Senate Judiciary B Committee or a designee appointed by the8 chairman of the committee.9 (2) A member of the House Judiciary Committee or a designee appointed by he10 chairman of the committee.11 (3) Two members of the Louisiana Association of Educators appointed by the12 president of the association.13 (4) One member of the faculty of the College of Education at Southern University14 appointed by the dean of the college.15 (5) One member of the faculty of the College of Education at Louisiana State16 University in Baton Rouge appointed by the dean of the college.17 (6) One member of the Louisiana Children's Defense fund appointed by the executive18 director of the organization.19 (7) One parent appointed by the chairman of the Senate Judiciary B Committee.20 (8) One member of the Louisiana Association of School Superintendents designated21 by the association.22 (9) One member of the Louisiana Association of School Administrators designated23 by the association.24 (10) The state superintendent of education or his designee.25 (11) One member representing the Louisiana Association of Clinical Social Workers26 designated by the association.27 BE IT FURTHER RESOLVED that the names of the individuals appointed or28 designated to serve on the committee shall be submitted to the chairman of the Senate29 Judiciary B Committee on or before July 1, 2012.30 SCR NO. 125 SLS 12RS-4326 ORIGINAL Page 3 of 3 BE IT FURTHER RESOLVED that the committee shall hold an organizational1 meeting before August 1, 2012, at the call of the chairman of the Judiciary B Committee.2 BE IT FURTHER RESOLVED that members of the special committee shall serve3 without compensation but may be reimbursed for incurred expenses by the member's4 appointing authority; that legislative members shall receive such per diem and expenses as5 is provided for legislators during attendance at committee meetings; and that other members6 shall be paid by the member's appointing authority in accordance with travel regulations7 applicable to the respective appointing departments, agencies, or associations.8 BE IT FURTHER RESOLVED that the special committee should study the9 feasibility of requiring a signed document which verifies that a school employee has been10 trained as part of a pre-service program and completed professional development and/or11 continuing education regarding the legal, ethical, professional and boundary rules governing12 inappropriate communication between a school employee and student.13 BE IT FURTHER RESOLVED that the special committee shall make a written14 report of its findings to the Senate Judiciary B Committee, together with any specific15 proposals for legislation, not later than November 2, 2012.16 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the17 Louisiana Association of Educators, College of Education at Southern University, College18 of Education at LSU, Louisiana Children's Defense Fund, Louisiana Association of School19 Superintendents, Louisiana Association of School Administrators, the state superintendent20 of education, and the Louisiana Association of Clinical Social Workers.21 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by James Benton.
