SENATE CONCURRENT RESOLUTI ON NO. 41

COASTAL PROTECT/RES AUTH. Approves the annual integrated coastal protection plan
for Fiscal Year 2012-2013.
A CONCURRENT RESOLUTI ON1
To approve the annual integrated coastal protection plan for Fiscal Year 2012-2013, as2
adopted by the Coastal Protection and Restoration Authority.3
WHEREAS, R.S. 49:214.5.1 et seq., provides for the creation, duties, and4
responsibilities of the Coastal Protection and Restoration Authority (authority); and5
WHEREAS, the powers and duties of the authority include the development of an6
annual state integrated coastal protection plan for protecting, conserving, and restoring the7
coastal area through the construction and management of integrated coastal restoration8
projects and programs, including privately funded marsh management projects or plans, and9
addressing those activities requiring coastal use permit which significantly affect such10
projects; and11
WHEREAS, as required under the provision of R.S. 49:214.5.3, the annual state12
integrated coastal protection plan adopted by the authority must be submitted to the Senate13
Committee on Natural Resources and the House Committee on Natural Resources and14
Environment and the Senate Committee on Transportation, Highways and Public Works and15
the House Committee on Transportation, Highways, and Public Works, on or before the16
fifteenth day of the regular legislative session of each year; and17
WHEREAS, such committees must take action on the annual state integrated coastal18 SCR NO. 41

protection plan, and the legislature may approve or disapprove the annual state integrated1
coastal protection plan by resolution adopted by a majority vote of the members of each2
house of the legislature; and3
WHEREAS, the annual state integrated coastal protection plan shall not be effective4
or implemented unless both houses of the legislature approve the annual plan, or fail to5
disapprove the annual state integrated coastal protection plan by July 1, 2012; and6
WHEREAS, the authority shall implement the annual state integrated coastal plan7
if the legislature approves the plan or if the legislature fails to timely disapprove the plan.8
THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby9
approve the Fiscal Year 2012-2013 annual plan for integrated coastal protection, as adopted10
by the Coastal Protection and Restoration Authority.11
BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the12
chairman of the Coastal Protection and Restoration Authority.13
