GERMAIN, TALBOT AND WHITNEY A CONCURRENT RESOLUTI ON To approve the annual integrated coastal protection plan for Fiscal Year 2012-2013, as adopted by the Coastal Protection and Restoration Authority. WHEREAS, R.S. 49:214.5.1 et seq., provides for the creation, duties, and responsibilities of the Coastal Protection and Restoration Authority (authority); and WHEREAS, the powers and duties of the authority include the development of an annual state integrated coastal protection plan for protecting, conserving, and restoring the coastal area through the construction and management of integrated coastal restoration projects and programs, including privately funded marsh management projects or plans, and addressing those activities requiring coastal use permit which significantly affect such projects; and WHEREAS, as required under the provision of R.S. 49:214.5.3, the annual state integrated coastal protection plan adopted by the authority must be submitted to the Senate Committee on Natural Resources and the House Committee on Natural Resources and Environment and the Senate Committee on Transportation, Highways and Public Works and the House Committee on Transportation, Highways, and Public Works, on or before the fifteenth day of the regular legislative session of each year; and WHEREAS, such committees must take action on the annual state integrated coastal protection plan, and the legislature may approve or disapprove the annual state integrated coastal protection plan by resolution adopted by a majority vote of the members of each house of the legislature; and SCR NO. 41 ENROLLED Page 2 of 2 WHEREAS, the annual state integrated coastal protection plan shall not be effective or implemented unless both houses of the legislature approve the annual plan, or fail to disapprove the annual state integrated coastal protection plan by July 1, 2012; and WHEREAS, the authority shall implement the annual state integrated coastal plan if the legislature approves the plan or if the legislature fails to timely disapprove the plan. THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby approve the Fiscal Year 2012-2013 annual plan for integrated coastal protection, as adopted by the Coastal Protection and Restoration Authority. BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the chairman of the Coastal Protection and Restoration Authority.
