COURTS:  Provides for an automobile allowance for the clerk of court of certain parishes
AN ACT1
To amend and reenact R.S. 13:783(D)(7), relative to expenses of the clerks of court; to2
authorize an automobile expense allowance for the clerks of court for certain3
parishes; to require the purchase of automobile insurance for bodily injury and4
property damage; to allocate surplus funds to the expense allowance; to prohibit5
additional expenses from being paid by the state or local governing authority; and6
to provide for related matters.7
Be it enacted by the Legislature of Louisiana:8
Section 1. R.S. 13:783(D)(7) is hereby amended and reenacted to read as follows:9

(7) In Acadia Parish, Bienville Parish, Bossier Parish, Caddo Parish,14
Cameron Parish, Claiborne Parish, DeSoto Parish, East Feliciana Parish, Franklin15
Parish, Iberia Parish, Lincoln Parish, Morehouse Parish, Natchitoches Parish,16
Ouachita Parish, Red River Parish, St. Charles Parish, St. Helena Parish, St. Landry17
Parish, St. Tammany Parish, Tangipahoa Parish, Vermilion Parish, Washington18
Parish, Webster Parish, West Baton Rouge Parish, and West Feliciana Parish, the19

allowance equal to fifteen percent of their annual salary provided the clerk of court1
maintains three hundred thousand dollars of automobile insurance per accident for2
bodily injury and one hundred thousand dollars of automobile insurance per accident3
for property damage. The expense allowance shall come from surplus funds in each4
of the offices of the clerks of court and at no additional expense to the state or local5
governing authority.6

Abstract: Authorizes an automobile expense allowance equal to 15% of certain clerks'
annual salaries provided that a certain amount of automobile insurance is maintained.
Present law authorizes each of the clerks of the district courts to purchase an automobile for
office use after obtaining consent of the governing authority of the parish.
Present law authorizes the clerks of the district courts of Acadia Parish, Cameron Parish,
East Feliciana Parish, Franklin Parish, Iberia Parish, Red River Parish, St. Charles Parish,
St. Landry Parish, St. Tammany Parish, Tangipahoa Parish, Vermilion Parish, Washington
Parish, West Baton Rouge Parish, and West Feliciana Parish to receive an automobile
expense allowance equal to 15% of their annual salary provided the clerk of court maintains
$300,000 of automobile insurance per accident for bodily injury and $100,000 of automobile
insurance per accident for property damage.  
Present law requires the expense allowance to come from surplus funds in each of the offices
of the clerks of court and at no additional expense to the state or local governing authority.
Proposed law retains present law and adds the clerks for the district court of Bienville Parish,
Bossier Parish, Caddo Parish, Claiborne Parish, DeSoto Parish, Lincoln Parish, Morehouse
Parish, Natchitoches Parish, Ouachita Parish, St. Helena Parish, and Webster Parish.
