Regular Session, 2013 HOUSE BILL NO. 245 BY REPRESENTATIVE LAMBERT WILDLIFE & FISHERIES: Provides for the issuance of nonresident recreational hunting and fishing licenses at the same cost as resident licenses AN ACT1 To amend and reenact R.S. 56:103.1(B)(1), 104(A)(2) and (4), 105(B), 153, 302.1(A) and2 (C)(1)(a), relative to hunting and fishing license fees; to provide for the license fees3 required for nonresidents; to provide for effective dates; and to provide for related4 matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 56:103.1(B)(1), 104(A)(2) and (4), 105(B), 153, 302.1(A) and7 (C)(1)(a) are hereby amended and reenacted to read as follows:8 §103.1. Nonresident licenses; penalties9 * * *10 B.(1) In order to hunt, take, possess, or transport deer or turkey in Louisiana,11 in addition to a nonresident basic hunting license, a nonresident shall be required to12 purchase and have on his person a nonresident big game license. In order to hunt,13 take, possess, or transport waterfowl in Louisiana, in addition to a nonresident basic14 hunting license, a nonresident shall be required to purchase and have on his person15 a nonresident duck license. The fee for an annual nonresident duck license shall be16 twenty-five dollars five dollars and fifty cents. The fee for an annual nonresident wild turkey license shall be twenty1 dollars and fifty cents five dollars and fifty cents.2 * * *3 §104. License fees; reciprocity; exceptions4 A. No license shall be issued under this Part unless there has been previously5 paid a fee or fees as hereinafter set forth:6 * * *7 (2) In the case of a nonresident who is sixteen years of age or older, a basic8 hunting license fee of two hundred fifteen dollars for the entire season is required to9 hunt, take, possess, or transport wild birds or wild quadrupeds on which open10 seasons are declared. Special additional licenses are required to hunt, take, possess,11 or transport deer, turkey, or migratory waterfowl.12 * * *13 (4) Except as specified in Subsection B of this Section, in addition to a14 nonresident hunting license, a nonresident shall be required to purchase and possess15 a nonresident big game license for a fee of two hundred twenty-five fifteen dollars16 for the entire season in order to hunt, take, possess, or transport deer, turkey, or17 bobcat. In addition, a fee of fifty dollars ten dollars and fifty cents shall be charged18 a nonresident for the issuance of a special primitive firearms license to take deer19 during the special deer season for primitive firearms as provided in R.S.20 56:103.1(B)(2).21 * * *22 §105. Special permits and licenses; scientific or entertainment purposes; bow23 licenses; beaver permit24 * * *25 B. In addition to all other licenses required by law, a special bow license is26 authorized allowing the holder of such a license to hunt with bows during bow27 hunting season. Design, marketing, and sale of duck stamps and prints4 The department shall provide by regulation for the annual creation of duck5 stamps and duck stamp prints, the manner of selection of an artist and the manner of6 reproduction, distribution, marketing and sale of such stamps and prints. Purchase7 of such stamps and prints shall not authorize the purchaser to hunt, take, possess, or8 transport ducks in the state of Louisiana. The secretary is hereby authorized to sell9 such stamps and prints by the method he deems to be most beneficial to the10 department, including public or private auction or direct sale to an individual, group,11 or organization. The cost for a resident duck stamp shall be five dollars and fifty12 cents and the cost for a nonresident duck stamp shall be twenty-five dollars five13 dollars and fifty cents. The department shall retain exclusive ownership and14 production rights to the design for reproduction of duck stamps and prints to sell to15 hunters, collectors, and other interested persons. Upon completion of this process,16 the original artwork shall be returned to the artist.17 * * *18 §302.1. Annual license; temporary license; fees; saltwater fee; exemptions19 A. The cost of the annual basic recreational fishing license is nine dollars20 and fifty cents for residents and sixty dollars nine dollars and fifty cents for21 nonresidents, except that residents using a rod or fishing pole, hook and line, without22 a reel and without using artificial bait shall pay two dollars and fifty cents per year;23 however, any person required by this Part to possess a basic two dollars and fifty24 cents license shall be subject to a maximum fine of five dollars for not possessing the25 license as herein required, and there shall be no court costs associated with the fine.26 * * *27 C.(1)(a) In addition to the annual basic recreational fishing license, any28 person fishing in the saltwater areas of the state defined in R.S. 56:322 must29 HLS 13RS-376 ENGROSSED HB NO. 245 Page 4 of 7 CODING: Words in struck through type are deletions from existing law; words underscored are additions. purchase a saltwater license. The fee for the annual saltwater license is five dollars1 and fifty cents for residents and thirty dollars five dollars and fifty cents for2 nonresidents. As a condition of the application for and the granting of the saltwater3 license, all saltwater finfish caught or transported by the license holder while the4 license is in effect are presumed to have been taken in the waters of Louisiana.5 * * *6 Section 2. R.S. 56:103.1(B)(1), 104(A)(2) and (4), 105(B), 153, 302.1(A) and7 (C)(1)(a) are hereby amended and reenacted to read as follows:8 §103.1.
