FIRE PROTECT/FIRE MARSHAL: Adds failure to register as a convicted arsonist and
violations of a fire marshal's orders to the list of offenses for which a fire marshal
may conduct investigations and make arrests
AN ACT1
To amend and reenact R.S. 40:1563.1(A)(17) and to enact R.S. 40:1563.1(A)(18) and (19),2
relative to the authority of fire marshals to conduct investigations and make arrests;3
to add failure to register as a convicted arsonist and violation of a fire marshal's4
orders to the list of offenses for which a fire marshal may conduct investigations and5
make arrests; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1. R.S. 40:1563.1(A)(17) is hereby amended and reenacted and R.S.8
40:1563.1(A)(18) and (19) are hereby enacted to read as follows: 9
ยง1563.1.  Authority to make arrests and carry firearms; arson task force10
A. The fire marshal, the first assistant fire marshal, each deputy fire marshal,11
certified local authorities, and state or municipal arson investigators, while engaged12
in the performance of their duties as such, shall have the authority to investigate and13
cause the arrest of individuals suspected of having violated the following criminal14
laws:15

to commit the foregoing offenses.2

Abstract: Adds the crimes of failure to register as a convicted arsonist and violations of a
fire marshal's orders to the list of offenses for which a fire marshal may conduct
investigations and make arrests.
Present law provides for specific offenses for which a fire marshal, the first assistant fire
marshal, each deputy fire marshal, certified local authorities, and state or municipal arson
investigators, while engaged in the performance of their duties as such, are authorized to
investigate and make arrests.
Present law provides for the crime of failure to register as a convicted arsonist and violations
of a fire marshal's orders.
Proposed law retains present law and adds the crimes of failure to register as a convicted
arsonist and violations of a fire marshal's orders to the list of offenses for which a fire
marshal, the first assistant fire marshal, each deputy fire marshal, certified local authorities,
and state or municipal arson investigators, while engaged in the performance of their duties
as such, are authorized to conduct investigations and make arrests.
