PROPERTY/PUBLIC: Provides relative to the transfer of a certain parcel of land from La. Tech University to the city of Ruston AN ACT1 To authorize and provide for the transfer of certain state property; to authorize the transfer2 of certain state property in Lincoln Parish from Louisiana Tech University to the city3 of Ruston; to provide for the property description; to provide for reservation of4 mineral rights; to provide terms and conditions of such transfer; to provide an5 effective date; and to provide for related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. The president of the University of Louisiana System on behalf of the state8 of Louisiana, notwithstanding any other provision of law to the contrary, is hereby9 authorized and empowered to convey, transfer, assign, lease, or deliver any interest,10 excluding mineral rights, the state may have to all or any portion of the following described11 parcel of property to the city of Ruston:12 The description of the property (the "Property") conveyed by Grace Methodist13 Church to the State of Louisiana and Louisiana Tech University by sale of land dated14 December 6, 1981, of record in Conveyance Book 358, page 165, of the records of15 Lincoln Parish, Louisiana.16 Tract l17 Beginning at a concrete post which is located at the point where the South line of the18 NE/4 of NW/4 of Section 26, Township 18 North, Range 3 West, intersects the North19 and West Right of Way line of U.S. Highway No. 80, and run South 50 degrees 3520 minutes West along the said North and West Right of Way line of Highway No. 8021 for a distance of l49.5 feet, where the starting point is found. From said starting point22 run North 39 degrees 25 minutes West to the South line of the NE/4 of NW/4, said23 Section 26, a distance of l30 feet, thence West along the South line of said forty to24 the SW Corner of said as NE/4 of NW/4, Section 26, a distance of l30.5 feet, thence25 South on the forty line to the intersection of the North and West Right of Way line26 of U.S. Highway No. 80, a distance of 271 feet, thence North 50 degrees 35 minutes27 East along the North and West boundary line of said Highway No. 80, to starting28 point, a distance of 272 feet; and,29 HLS 13RS-856 ENGROSSED HB NO. 292 Page 2 of 3 Tract 21 Beginning at a concrete post which is located at the point where the South line of the2 NE/4 of NW/4 of Section 26, Township 18 North, Range 3 West, intersects the North3 and West Right of Way line of U.S. Highway No. 80, and run South 50 degrees 354 minutes West along the said North and West Right of Way line of Highway No. 805 for a distance of 74.5 feet where the starting point is found. From said starting point,6 run North 39 degrees 25 minutes West to the South line of the NE/4 of NW/4 of said7 Section 26, a distance of 66 feet, thence due West along said South line of said forty8 until striking the Corner of the property presently owned by said Church, a distance9 of 95 feet, thence run South 39 degrees 25 minutes East until striking the North and10 West Right of Way line of said Highway a distance of l30 feet, thence North 5011 degrees 35 minutes East along the said North and West Right of Way line of said12 Highway No. 80, to point of beginning, a distance of 75 feet, together with all13 improvements situated thereupon.14 The Property is also described as follows:15 Commence at the Northwest corner of the SE/4 of the NW/4 of Section 26,16 Township l8 North, Range 3 West, thence run due South for a distance of 14.40 feet17 to the starting point. From the starting point run East for a distance of 29.90 feet to18 a 1-inch iron pipe set in concrete in an existing fence corner; thence run North 87°58'19 East along said fence for a distance of 93 feet to a l l/2-inch iron pipe which is20 painted white; thence run due East for a distance of l2l.25 feet to a 3/4-inch iron pipe21 set in concrete on the West boundary of the town of Ruston, Louisiana, lot as22 described in Conveyance Book 34, at Page 400, of the records of the Clerk of Court23 of Lincoln Parish, Louisiana; thence run South 38°02' East along said boundary for24 a distance of 75.55 feet to an existing l/2" iron rod set in concrete on the North right25 of way line of Highway 80; thence run South 52°06' West along the North Right of26 Way line of U.S. Highway 80 for 368.26 feet, thence run North along Tech Drive for27 282.42 feet to the point of beginning.28 Section 2. The president of the University of Louisiana System on behalf of the29 state of Louisiana is hereby authorized to enter into such agreements, covenants, conditions,30 and stipulations and to execute such documents as necessary to properly effectuate any31 conveyance, transfer, assignment, lease, or delivery of title, excluding mineral rights, to the32 property described in Section 1 of this Act, and as more specifically described in any such33 agreements entered into and documents executed by and between the president of the34 University of Louisiana System on behalf of the state of Louisiana and the city of Ruston,35 in exchange of consideration proportionate to the appraised value of the property.36 Section 3. This Act shall become effective upon signature by the governor or, if not37 signed by the governor, upon expiration of the time for bills to become law without signature38 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.
