PUBLIC CONTRACTS:  Provides relative to contract limits for certain levee projects
AN ACT1
To amend and reenact R.S. 38:2212(A)(1)(d)(v)(bb) and to enact R.S.2
38:2212(A)(1)(d)(v)(cc), relative to public contracts for certain levee projects; to3
provide with respect to contract limits for work on certain levees; and to provide for4
related matters.5
Notice of intention to introduce this Act has been published6
as provided by Article III, Section 13 of the Constitution of7
Louisiana.8
Be it enacted by the Legislature of Louisiana:9
Section 1. R.S. 38:2212(A)(1)(d)(v)(bb) is hereby amended and reenacted and R.S.10
38:2212(A)(1)(d)(v)(cc) is hereby enacted to read as follows:11
§2212. Advertisement and letting to lowest responsible bidder; public work;12
electronic bidding; participation in mentor-protégé program; exemptions13

(d) The term "contract limit" as used herein shall be equal to the sum of one16
hundred fifty thousand dollars per project, including labor, materials, and equipment17
as per the rates in the latest edition of the Associated Equipment Dealers Rental Rate18
Book and administrative overhead not to exceed fifteen percent; however:19

(bb) Except as provided in Subitem (cc) of this Item, the The provisions of3
this Item shall remain effective for contracts awarded, or agreements entered into,4
until December 31, 2014.5
(cc) The provisions of this Item shall remain effective for contracts issued6
by the Terrebonne Levee and Conservation District and the South Lafourche Levee7
District until December 31, 2016.8

Section 2. This Act shall become effective upon signature of the governor or, if not10
signed by the governor, upon expiration of the time for the bills to become law without11
signature by the governor, as provided by Article III, Section 18 of the Constitution of12
Louisiana. If vetoed by the governor and subsequently approved by the legislature, this Act13
shall become effective on the day following such approval.14

Abstract: Extends the $1,000,000 contract limit for certain levee projects in the Terrebonne
Levee and Conservation District and the South Lafourche Levee District until Dec.
31, 2016.
Present law requires public work exceeding the contract limit of $150,000 to be advertised
and let to the lowest responsible bidder. Provides for a contract limit of $1,000,000 for work
on certain levees for contracts awarded, or agreements entered into, until Dec. 31, 2014.
Proposed law retains present law except it extends the $1,000,000 contract limit for contracts
issued by the Terrebonne Levee and Conservation District and the South Lafourche Levee
District from Dec. 31, 2014 to Dec. 31, 2016.
Effective upon signature of governor or lapse of time for gubernatorial action.
