CONTROLLED SUBSTANCES:  Provides relative to access to state prescription
monitoring program information
AN ACT1
To amend and reenact R.S. 40:1007(E)(1), relative to access to prescription monitoring2
information; to add certain delegates to the persons authorized to access prescription3
monitoring information; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 40:1007(E)(1) is hereby amended and reenacted to read as follows:6
ยง1007.  Access to prescription monitoring information7

E. The following persons, after successful completion of the educational9
courses identified in R.S. 40:1008, may access prescription monitoring information10
at no cost and in the same or similar manner, and for the same or similar purposes,11
as those persons are authorized to access similar protected health information under12
federal and state law and regulation:13
(1) Persons authorized to prescribe or dispense controlled substances or14
drugs of concern, or their delegates as defined by rule, for the purpose of providing15
medical or pharmaceutical care for their patients, or for verifying their prescribing16
records.17

Abstract: Adds certain delegates to the persons authorized to access state prescription
monitoring program information.
Present law establishes the state prescription monitoring system, an electronic system for the
monitoring of controlled substances and other drugs of concern that are dispensed in the state
or dispensed to an address within the state.
Proposed law retains present law.
Present law provides that, except as provided in present law, prescription monitoring
information submitted to the La. Board of Pharmacy shall be protected health information,
not subject to public or open records law and not subject to disclosure. 
Proposed law retains present law.
Present law provides that persons authorized to prescribe or dispense controlled substances
or drugs of concern, after successful completion of the required educational courses, may
access prescription monitoring information for the purpose of providing medical or
pharmaceutical care for their patients or for verifying their prescribing records.
Proposed law retains present law and adds delegates of persons authorized to prescribe or
dispense controlled substances or drugs of concern.
