HEALTH CARE: (Constitutional Amendment)  Provides relative to prohibiting mandatory
participation in a health care system
A JOINT RESOLUTION1
Proposing to add Article I, Section 28 of the Constitution of Louisiana, to prohibit2
mandatory participation in a health care system; to provide for submission of the3
proposed amendment to the electors; and to provide for related matters.4
Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members5
elected to each house concurring, that there shall be submitted to the electors of the state of6
Louisiana, for their approval or rejection in the manner provided by law, a proposal to add7
Article I, Section 28 of the Constitution of Louisiana, to read as follows:8
§28.  Freedom to Choose Health Care9
Section 28.(A) In order to preserve the freedom of all residents of Louisiana10
to provide for their own health care, no law or rule shall compel, directly or11
indirectly, any person, employer, or health care provider to participate in a health12
care system.13
(B)(1) A person or employer may pay directly for health care services and14
shall not be required to pay penalties or fines for paying directly for lawful health15
care services.16
(2) A health care provider may accept direct payment for lawful health care17
services and shall not be required to pay penalties or fines for accepting direct18

(C) The purchase or sale of health insurance in private health care systems1
shall not be prohibited by law or rule.2
Section 2. Be it further resolved that this proposed amendment shall be submitted3
to the electors of the state of Louisiana at the statewide election to be held on November 4,4
2014.5
Section 3. Be it further resolved that on the official ballot to be used at the election,6
there shall be printed a proposition, upon which the electors of the state shall be permitted7
to vote YES or NO, to amend the Constitution of Louisiana, which proposition shall read as8
follows:9
Do you support an amendment to prohibit any law or administrative rule10
requiring any person, employer, or health care provider to participate in a11
health care system? (Adds Article I, Section 28)12
