EXCEP PERSON/DISABLED: Provides relative to parking spaces for certain disabled persons AN ACT1 To enact R.S. 40:1742(A)(4), relative to parking spaces for certain disabled persons; to2 require access aisles to have the phrase "No Parking" written upon the pavement; to3 provide for penalties; to provide for applicability; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 40:1742(A)(4) is hereby enacted to read as follows: 6 §1742. Parking spaces for certain disabled persons7 A.8 * * *9 (4)(a) In addition to the ADA Standards specifications, each access aisle, or10 any other area of the pavement adjacent to a parking space reserved for mobility-11 impaired persons that is designated for the loading and unloading of vehicles parked12 in the space, shall have the phrase "NO PARKING" written upon the pavement area13 using letters that are not less than twelve inches tall.14 (b) Violations of this Paragraph shall be subject to the penalties provided for15 in R.S. 40:1743.16 (c) The provisions of this Paragraph shall apply to all parking spaces newly17 constructed or existing parking spaces whose markings are repainted after the18 effective date of this Paragraph.19 * * *20 HLS 13RS-1028 ORIGINAL HB NO. 582 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. Present law requires each state agency and political subdivision having jurisdiction over a public facility and each owner or lessee of a private facility to provide and maintain a minimum number of specially designed and marked motor vehicle parking spaces for the exclusive use of persons whose vehicles are identified by license plates, hang tags, or special parking cards for the mobility impaired. Present law further requires the mobility-impaired parking spaces to adhere to the ADA Standards and to include mobility-impaired loading and unloading areas, access aisles, access ramps, and curb cuts. Proposed law retains present law. Proposed law requires, in addition to the ADA Standards specifications, each access aisle, or any other area of the pavement adjacent to a parking space reserved for mobility-impaired persons that is designated for the loading and unloading of vehicles parked in the space, shall have the phrase "NO PARKING" written upon the pavement area using letters that are not less than twelve inches tall. Proposed law provides that violations of proposed law shall be shall be fined not more than $500 or imprisoned for not more than six months, or both. Proposed law applies to all parking spaces newly constructed or existing parking spaces whose markings are repainted after the effective date of proposed law. (Adds R.S. 40:1742(A)(4))
