Regular Session, 2013 HOUSE BILL NO. 633 BY REPRESENTATIVE LEBAS Prefiled pursuant to Article III, Section 2(A)(4)(b)(i) of the Constitution of Louisiana. ANIMALS: Provides relative to preventing the spread of disease through the unlawful transportation of diseased animals, livestock, or adulterated meat AN ACT1 To amend and reenact R.S. 3:2137 and enact R.S. 3:2130, relative to preventing the spread2 of disease; redesignates provisions of current law; and to provide for related matters.3 Be it enacted by the Legislature of Louisiana:4 Section 1. R.S. 3:2137 is hereby amended and reenacted and R.S. 3:2130 is hereby5 enacted to read as follows:6 §2130. Definitions7 As used in this Chapter, the following terms shall have the following8 meanings, except where the context expressly indicates otherwise;9 (1) "Adulterated meat" means any animal carcass, part thereof, meat or meat10 product, or any human or animal food additive or supplement containing or derived11 from animal protein, that bears or contains any bacteria, disease, microorganism,12 virus, or other pest that could cause serious illness or death in humans or animals or13 could cause animals to become economically unproductive.14 (2) "Diseased livestock" means any livestock that is infected with or carries15 any bacteria, disease, microorganism, virus, or other pest that could cause serious16 illness or death in humans or animals or could cause animals to become17 economically unproductive.18 (3) "Livestock" means any animal bred, kept, maintained, raised, or used for19 show, profit, or for the purpose of selling or otherwise producing crops, animals, or20 HLS 13RS-1078 ENGROSSED HB NO. 633 Page 2 of 4 CODING: Words in struck through type are deletions from existing law; words underscored are additions. plant or animal products for market. This definition includes cattle, buffalo, bison,1 oxen, and other bovine; horses, mules, donkeys, and other equine; sheep; goats;2 swine; domestic rabbits; fish, turtles, and other animals identified with aquaculture3 that are located in artificial reservoirs or enclosures that are both on privately owned4 property and constructed so as to prevent, at all times, the ingress and egress of fish5 life from public waters; imported exotic deer and antelope, elk, farm-raised white-6 tailed deer, farm-raised ratites, and other farm-raised exotic animals; chickens,7 turkeys, and other poultry; and animals placed under the jurisdiction of the8 commissioner of agriculture and forestry and any hybrid, mixture, or mutation of any9 such animal.10 * * *11 §2137. Unlawful transportation of diseased animals or livestock or adulterated meat12 A. For purposes of this Chapter the following terms shall mean:13 (1) "Adulterated meat" means any animal carcass, part thereof, meat or meat14 product, or any human or animal food additive or supplement containing or derived15 from animal protein, that bears or contains any bacteria, disease, microorganism,16 virus, or other pest that could cause serious illness or death in humans or animals or17 could cause animals to become economically unproductive.18 (2) "Diseased livestock" means any livestock that is infected with or carries19 any bacteria, disease, microorganism, virus, or other pest that could cause serious20 illness or death in humans or animals or could cause animals to become21 economically unproductive.22 (3) "Livestock" means any animal bred, kept, maintained, raised, or used for23 show, profit, or for the purpose of selling or otherwise producing crops, animals, or24 plant or animal products for market. A. It shall be unlawful for anyone to knowingly bring into the state or to6 transport through this state or to move within this state any adulterated meat or7 diseased livestock or animals without the express written approval of the8 commissioner of agriculture and forestry or his designee. The board shall adopt rules9 and regulations in accordance with this Chapter for the enforcement of this Section.10 C. B. Any person who knowingly violates any of the provisions of this11 Section or any rule or regulation administered and enforced by the board pursuant12 to this Section shall be subject to a civil penalty of five thousand dollars imposed in13 accordance with R.S. 3:2093. Each act of bringing, transporting, or moving diseased14 livestock or adulterated meat into, through, or within this state shall be a separate15 violation. Each day or partial day shall be a separate violation.16 D. C. In addition to the civil penalties and civil relief provided for in this17 Chapter, whoever intentionally, or in a criminally negligent manner, violates the18 provisions of this Section or the rules and regulations adopted pursuant to this19 Section shall be guilty of a crime and, upon conviction, shall be fined not less than20 five thousand, nor more than twenty-five thousand dollars or imprisoned, with or21 without hard labor, for not less than one year, nor more than ten years, or both.22 DIGEST The digest printed below was prepared by House Legislative Services.
