Regular Session, 2013 HOUSE BILL NO. 633 BY REPRESENTATIVE LEBAS AND SENATOR THOMPSON Prefiled pursuant to Article III, Section 2(A)(4)(b)(i) of the Constitution of Louisiana. AN ACT1 To amend and reenact R.S. 3:2137 and enact R.S. 3:2130, relative to preventing the spread2 of disease; redesignates provisions of current law; and to provide for related matters.3 Be it enacted by the Legislature of Louisiana:4 Section 1. R.S. 3:2137 is hereby amended and reenacted and R.S. 3:2130 is hereby5 enacted to read as follows:6 §2130. Definitions7 As used in this Chapter, the following terms shall have the following8 meanings, except where the context expressly indicates otherwise;9 (1) "Adulterated meat" means any animal carcass, part thereof, meat or meat10 product, or any human or animal food additive or supplement containing or derived11 from animal protein, that bears or contains any bacteria, disease, microorganism,12 virus, or other pest that could cause serious illness or death in humans or animals or13 could cause animals to become economically unproductive.14 (2) "Diseased livestock" means any livestock that is infected with or carries15 any bacteria, disease, microorganism, virus, or other pest that could cause serious16 illness or death in humans or animals or could cause animals to become17 economically unproductive.18 (3) "Livestock" means any animal bred, kept, maintained, raised, or used for19 show, profit, or for the purpose of selling or otherwise producing crops, animals, or20 plant or animal products for market. This definition includes cattle, buffalo, bison,21 oxen, and other bovine; horses, mules, donkeys, and other equine; sheep; goats;22 swine; domestic rabbits; fish, turtles, and other animals identified with aquaculture23 ENROLLEDHB NO. 633 Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. that are located in artificial reservoirs or enclosures that are both on privately owned1 property and constructed so as to prevent, at all times, the ingress and egress of fish2 life from public waters; imported exotic deer and antelope, elk, farm-raised white-3 tailed deer, farm-raised ratites, and other farm-raised exotic animals; chickens,4 turkeys, and other poultry; and animals placed under the jurisdiction of the5 commissioner of agriculture and forestry and any hybrid, mixture, or mutation of any6 such animal.7 * * *8 §2137. Unlawful transportation of diseased animals or livestock or adulterated meat9 A. For purposes of this Chapter the following terms shall mean:10 (1) "Adulterated meat" means any animal carcass, part thereof, meat or meat11 product, or any human or animal food additive or supplement containing or derived12 from animal protein, that bears or contains any bacteria, disease, microorganism,13 virus, or other pest that could cause serious illness or death in humans or animals or14 could cause animals to become economically unproductive.15 (2) "Diseased livestock" means any livestock that is infected with or carries16 any bacteria, disease, microorganism, virus, or other pest that could cause serious17 illness or death in humans or animals or could cause animals to become18 economically unproductive.19 (3) "Livestock" means any animal bred, kept, maintained, raised, or used for20 show, profit, or for the purpose of selling or otherwise producing crops, animals, or21 plant or animal products for market. A. It shall be unlawful for anyone to knowingly bring into the state or to3 transport through this state or to move within this state any adulterated meat or4 diseased livestock or animals without the express written approval of the5 commissioner of agriculture and forestry or his designee. The board shall adopt rules6 and regulations in accordance with this Chapter for the enforcement of this Section.7 C. B. Any person who knowingly violates any of the provisions of this8 Section or any rule or regulation administered and enforced by the board pursuant9 to this Section shall be subject to a civil penalty of five thousand dollars imposed in10 accordance with R.S. 3:2093. Each act of bringing, transporting, or moving diseased11 livestock or adulterated meat into, through, or within this state shall be a separate12 violation. Each day or partial day shall be a separate violation.13 D. C. In addition to the civil penalties and civil relief provided for in this14 Chapter, whoever intentionally, or in a criminally negligent manner, violates the15 provisions of this Section or the rules and regulations adopted pursuant to this16 Section shall be guilty of a crime and, upon conviction, shall be fined not less than17 five thousand, nor more than twenty-five thousand dollars or imprisoned, with or18 without hard labor, for not less than one year, nor more than ten years, or both.19 SPEAKER OF THE HOUSE OF REPRESENTATI VES PRESIDENT OF THE SENATE GOVERNOR OF THE STATE OF LOUISIANA APPROVED:
