Regular Session, 2013 HOUSE BILL NO. 671 BY REPRESENTATIVE FOIL STUDENT/TUITION: Authorizes the LSU Board of Supervisors to impose certain tuition and fee amounts at certain institutions AN ACT1 To enact R.S. 17:3351.11(E) and 3351.17 through 3351.19, relative to the Board of2 Supervisors of Louisiana State University and Agricultural and Mechanical College;3 to authorize the board to impose certain tuition and fee amounts at certain4 institutions; to provide for effectiveness; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 17:3351.11(E) and 3351.17 through 3351.19 are hereby enacted to7 read as follows: 8 §3351.11. Board of Supervisors of Louisiana State University and Agricultural and9 Mechanical College; tuition and attendance fee amounts; Health Sciences10 Centers; waivers11 * * *12 E. In addition to the authority granted by this Section and any other provision13 of law, including but not limited to R.S. 17:3139.5, and in accordance with the14 provisions of Article VII, Section 2.1(A) of the Constitution of Louisiana, the Board15 of Supervisors of Louisiana State University and Agricultural and Mechanical16 College may impose the following fees for students enrolled in Louisiana State17 University Health Sciences Center-New Orleans School of Dentistry for the 2013-18 2014 academic year and thereafter: 19 HLS 13RS-1169 ORIGINAL HB NO. 671 Page 2 of 6 CODING: Words in struck through type are deletions from existing law; words underscored are additions. (1) A dental supply fee of three hundred dollars per academic year for1 students in the doctor of dental surgery program, the dental hygiene program, and the2 dental laboratory technology program.3 (2) A prosthetic device fee of two hundred seventy-five dollars per academic4 year for second-year students in the doctor of dental surgery program.5 * * *6 §3351.17. Board of Supervisors of Louisiana State University and Agricultural and7 Mechanical College; tuition and attendance fees; distance education8 A. In addition to the authority granted by any other provision of law,9 including but not limited to R.S. 17:3139.5, and in accordance with Article VII,10 Section 2.1 of the Constitution of Louisiana, the Board of Supervisors of Louisiana11 State University and Agricultural and Mechanical College may impose at Louisiana12 State University and Agricultural and Mechanical College at Baton Rouge for the13 Fall 2013 semester and thereafter tuition and attendance fees for students enrolled14 in an academic degree program offered entirely through distance education as15 defined by the Southern Association of Colleges and Schools when such program is16 comparable to a program offered through traditional in-person classroom instruction.17 B. The authority granted in Subsection A of this Section shall include the18 authority to impose proportional amounts for part-time students and for summer19 sessions.20 C. The board shall establish criteria for waiving the tuition and fees21 authorized in Subsection A of this Section in cases of financial hardship as22 determined by the board. Board of Supervisors of Louisiana State University and Agricultural and1 Mechanical College; digital media program fee; amount; waivers2 A. In addition to the authority granted by any other provision of law,3 including but not limited to R.S. 17:3139.5, and in accordance with Article VII,4 Section 2.1 of the Constitution of Louisiana, the Board of Supervisors of Louisiana5 State University and Agricultural and Mechanical College may impose at Louisiana6 State University and Agricultural and Mechanical College at Baton Rouge for the7 Fall 2013 semester and thereafter a digital media program fee for students enrolled8 in graduate and professional degree programs in digital media in an amount not to9 exceed two thousand five hundred dollars per semester.10 B. The authority granted in Subsection A of this Section shall include the11 authority to impose proportional amounts for part-time students and for summer12 sessions.13 C. The board shall establish criteria for waiving the fee authorized in14 Subsection A of this Section in cases of financial hardship as determined by the15 board. Information relative to such waivers and the criteria and procedures for16 obtaining a waiver shall be made available to all prospective students in a timely17 manner such that each student is informed of the availability of a waiver prior to the18 student making a final decision concerning attendance.19 §3351.19. Board of Supervisors of Louisiana State University and Agricultural and20 Mechanical College; technology and infrastructure enhancement fee;21 amount; waivers22 A. In addition to the authority granted by any other provision of law,23 including but not limited to R.S. 17:3139.5, and in accordance with Article VII,24 Section 2.1 of the Constitution of Louisiana, the Board of Supervisors of Louisiana25 State University and Agricultural and Mechanical College may impose at Louisiana26 State University and Agricultural and Mechanical College at Baton Rouge a27 technology and infrastructure enhancement fee in the following amounts:28 HLS 13RS-1169 ORIGINAL HB NO. 671 Page 4 of 6 CODING: Words in struck through type are deletions from existing law; words underscored are additions. (1) For the 2013-2014 academic year, two dollars per student credit hour up1 to fifteen credit hours.2 (2) For the 2014-2015 academic year, four dollars per student credit hour up3 to fifteen credit hours.4 (3) For the 2015-2016 academic year, six dollars per student credit hour up5 to fifteen credit hours.6 (4) For the 2016-2017 academic year, eight dollars per student credit hour up7 to fifteen credit hours.8 (5) For the 2017-2018 academic year and thereafter, ten dollars per student9 credit hour up to fifteen credit hours.10 B. The authority granted in Subsection A of this Section shall include the11 authority to impose proportional amounts for part-time students and for summer12 sessions.13 C. The board shall establish criteria for waiving the fee authorized in14 Subsection A of this Section in cases of financial hardship as determined by the15 board. Information relative to such waivers and the criteria and procedures for16 obtaining a waiver shall be made available to all prospective students in a timely17 manner such that each student is informed of the availability of a waiver prior to the18 student making a final decision concerning attendance.19 Section 2. This Act shall become effective upon signature by the governor or, if not20 signed by the governor, upon expiration of the time for bills to become law without signature21 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. Proposed law authorizes the LSU Board of Supervisors to impose the following: LSU-Baton Rouge: (1) Tuition and attendance fees for students in an academic degree program offered entirely through distance education, as defined by the Southern Association of Colleges and Schools (SACS), when such program is comparable to a program offered through traditional in-person classroom instruction. (Fall 2013 semester and thereafter.) (2)A digital media program fee for students in graduate and professional degree programs in digital media in an amount not to exceed $2,500 per semester. (Fall 2013 semester and thereafter.) (3) A technology and infrastructure enhancement fee, as follows: (a) 2013-2014: $2 per credit hour, up to 15 credit hours. (b) 2014-2015: $4 per credit hour, up to 15 credit hours. (c) 2015-2016: $6 per credit hour, up to 15 credit hours. (d) 2016-2017: $8 per credit hour, up to 15 credit hours. (e) 2017-2018 and thereafter: $10 per credit hour, up to 15 credit hours. Proposed law, applicable to all proposed law relative to LSU-Baton Rouge, provides: (1)The board may impose proportional amounts for part-time students and for summer sessions. (2)The board shall establish criteria for hardship waivers and make information about them available to prospective students. LSU Health Sciences Center-New Orleans School of Dentistry: (1) For 2013-2014 and thereafter, a dental supply fee of $300 per academic year for students in the doctor of dental surgery program, the dental hygiene program, and the dental laboratory technology program. (2) For 2013-2014 and thereafter, a prosthetic device fee of $275 per academic year for second-year students in the doctor of dental surgery program. (3)Retains present law requirement that the board establish criteria for hardship waivers and make information about them available to prospective students. Proposed law, applicable to all proposed law for both LSU-Baton Rouge and the LSU School of Dentistry: (1) Provides that authority granted by all proposed law is in addition to any authority granted by present law, including the GRAD Act. (2)Provides that it is in accordance with present constitution, which provides that any new fee imposed or assessed by a state board or agency must be enacted by law by a 2/3 vote of the elected members of each house of the legislature.
