AN ACT1
To amend and reenact R.S. 48:231(A), relative to the highway priority construction2
program; to provide for the presentation of the proposed program of construction to3
members of the legislature; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 48:231(A) is hereby amended and reenacted to read as follows: 6
ยง231. Final construction program for current fiscal year; public hearings; Joint7
Highway Priority Construction Committee; reports; review by legislature;8
restrictions on legislature9
A.(1) Beginning on October 1, 2010, and not later than October 1 first of10
each year thereafter, the department shall provide a proposed program of11
construction for the coming fiscal year to the Joint Highway Priority Construction12
Committee.13
(2) The committee shall hold public hearings in each highway district for the14
purpose of reviewing priorities for the coming fiscal year.15
(3) At each public hearing, the department shall provide each House of16
Representatives and Senate member with a map indicating the following regarding17
projects within their respective House or Senate district:18
(a) All projects proposed for construction within their district for the coming19
fiscal year.20
(b) All completed projects within their district for the three previous fiscal21

(4) The department shall make the maps required to be provided to members1
of the legislature pursuant to Paragraph (3) of this Subsection available to any person2
upon request following the public hearings.3
(5) A report based on the testimony received at said the hearings shall be4
sent to the department. The department then shall shall then create the final5
construction program for the coming fiscal year for submission to the legislature.6
(6) When this final construction program is communicated to the legislature7
for funding for the coming fiscal year, any project which the legislature determines8
is not in the proper order of priority in accordance with the factors stated in R.S.9
48:229 may be deleted by the legislature. However, the legislature shall not add any10
projects to this final construction program, nor shall the legislature make11
substitutions for projects which have been removed.12
