HOUSE BILL NO. 727         (Substitute for House Bill No. 53 by Representative Seabaugh)

RETIREMENT/TEACHERS:  Provides relative to membership in the Teachers' Retirement
System of Louisiana
AN ACT1
To amend and reenact R.S. 11:701(33)(a)(iv), (v)(aa), (vii), and (x), relative to membership2
in the Teachers' Retirement System of Louisiana; to prohibit membership by3
employees of certain employers hired on or after a certain date; and to provide for4
related matters.5
Notice of intention to introduce this Act has been published as provided by6
Article X, Section 29(C) of the Constitution of Louisiana.7
Be it enacted by the Legislature of Louisiana:8
Section 1.  R.S. 11:701(33)(a)(iv), (v)(aa), (vii), and (x) are hereby amended and9
reenacted to read as follows: 10
ยง701.  Definitions11
As used in this Chapter, the following words and phrases have the meanings12
ascribed to them in this Section unless a different meaning is plainly required by the13
context:14

(33)(a) "Teacher", except as provided in Subparagraph (b) of this Paragraph,16
shall mean any of the following:17

(iv) The president and staff of the Louisiana Federation of Teachers hired by1
the federation prior to September 1, 2013, who were members of the Teachers'2
Retirement System prior to such employment.3
(v)(aa)  The president or secretary and staff of the Louisiana Association of4
Educators hired by the association prior to September 1, 2013.5

(vii) The director and staff of the Associated Professional Educators of7
Louisiana hired by the association prior to September 1, 2013.8

(x) The director and staff of the Louisiana Resource Center for Educators10
hired by the center prior to September 1, 2013.11

Section 2. This Act shall become effective upon signature by the governor or, if not13
signed by the governor, upon expiration of the time for bills to become law without signature14
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If15
vetoed by the governor and subsequently approved by the legislature, this Act shall become16
effective on the day following such approval.17

Abstract: Prohibits membership in the Teachers' Retirement System of Louisiana (TRSL)
for new hires of certain employers.  Allows current members of such employers to
retain their membership.
Present law (R.S. 11:701(33)) authorizes the following entities to enroll their employees in
TRSL:
(1)The Louisiana Federation of Teachers (if such employees were previously members
of TRSL).
(2)The Louisiana Association of Educators.
(3)The Associated Professional Educators of Louisiana.

Proposed law provides that new employees of such employers hired on or after Sept. 1,
2013, shall not be members of TRSL.
Present law provides that employees of the Louisiana High School Athletic Association
hired on or after July 1, 2011, shall not be members of TRSL.  Proposed law retains present
law.
Effective upon signature of governor or lapse of time for gubernatorial action.
