DISTRICTS/WATERWORKS:  Provides relative to the selection and terms of fiscal agents
of waterworks districts
AN ACT1
To amend and reenact R.S. 33:3817(C)(1), relative to waterworks districts; to provide2
relative to the appointment of a fiscal agent for such districts; to provide for the term3
of a fiscal agent; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 33:3817(C)(1) is hereby amended and reenacted to read as follows:6
ยง3817. Officers of board of commissioners of district; fiscal agent7

(C)(1)(a) The board of commissioners of the water district shall, at the time9
of their organization, select one of the solvent chartered banks within the parish10
where the district is organized in which all of the money of the district shall be11
deposited.12
(b)  They shall thereafter on On the first Monday in June annually of any year13
in which the term of a fiscal agent expires, the board of commissioners shall elect a14
fiscal agent for a term of no more than three years.15
(c) The board shall advertise its intent to select a fiscal agent at least after an16
advertisement of fifteen days prior to the election in a newspaper published in the17
district, and if there be no is not a newspaper published within the district, then in the18

commissioners may renew the election of a fiscal agent for one additional term1
without such advertisement.2
(d)  provided, however, that any Any funds received by the Lafourche water3
district from or for its sewerage system shall be maintained within the same or a4
separate account, as directed by the Lafourche Parish Police Jury.5

Section 2. The provisions of this Act shall become effective on the first Monday in7
June, 2014.8

Abstract: Authorizes the board of commissioners of waterworks districts to appoint a fiscal
agent for a period of up to three years rather than just one year.
Present law allows police juries to divide their respective parishes into waterworks districts.
Present law provides that the police jury shall appoint commissioners to govern waterworks
districts.
Present law provides that a waterworks district shall elect a fiscal agent every year. Requires
an advertisement in a local newspaper prior to each election.
Proposed law allows a waterworks district to elect a fiscal agent to serve a period of up to
three years. Further authorizes a district to renew the election of a fiscal agent for one term
without the advertisement required by 	present law.
Effective on the first Monday in June (June 2), 2014.
