HLS 13RS-1005 ORIGINAL Page 1 of 2 Regular Session, 2013 HOUSE CONCURRENT RESOLUTI ON NO. 107 BY REPRESENTATIVE JAY MORRIS WILLS/TESTAMENTS: Directs the Louisiana State Law Institute to study the feasibility of creating a central database for testaments A CONCURRENT RESOLUTI ON1 To authorize and direct the Louisiana State Law Institute to study and make2 recommendations relative to the feasibility of creating a central database for3 testaments and to report its findings and recommendations to the Louisiana4 Legislature no later than January 1, 2015.5 WHEREAS, executing a testament is one of the most important aspects of estate6 planning; and7 WHEREAS, a testament is crucial to the orderly handling of a person's estate, not8 only for financial matters, but also for personal matters such as tutorship and the caring for9 the family of the testator; and10 WHEREAS, properly executed testaments are occasionally misplaced or even11 improperly concealed or destroyed in order to subvert the decisions of the testator as to his12 estate; and13 WHEREAS, in order to alert interested parties that a testament has been executed and14 to deter the improper concealment or destruction of a testament, it may be beneficial to15 establish a voluntary central database to store testaments, the contents of a testament, or16 information noting the existence of a testament; and 17 WHEREAS, a central database could be created within the office of the secretary of18 state or the clerk of court for the parish in which the testator is domiciled.19 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby20 authorize and direct the Louisiana State Law Institute to study and make recommendations21 HLS 13RS-1005 ORIGINAL HCR NO. 107 Page 2 of 2 relative to the feasibility of creating a central database for testaments and that it report its1 findings and recommendations to the Louisiana Legislature no later than January 1, 2015.2 BE IT FURTHER RESOLVED that a suitable copy of this Resolution be transmitted3 to the director of the Louisiana State Law Institute.4 DIGEST The digest printed below was prepared by House Legislative Services.
