CHILDREN'S CODE. Provides relative to a physical examination of a suspected child
abuse victim. (8/1/13)
AN ACT1
To enact Children's Code Article 614(E), relative to evaluation orders; to provide for a2
physical examination after a contradictory hearing; and to provide for related3
matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  Children's Code Article 614(E) is hereby enacted to read as follows: 6

E.  Notwithstanding any provision of law to the contrary, upon a showing9
of good cause in an affidavit executed by the applicant and after a contradictory10
hearing, the court may order a second physical examination of the child or11
other children in the household by any physician.12

Present law permits the court, after a contradictory hearing, to order a psychological, or
psychiatric examination and evaluation of the child or other children in the household upon
a showing of good cause in an affidavit executed by the applicant. SB NO. 109
