Regular Session, 2013 ENROLLED SENATE BILL NO. 154 BY SENATOR MURRAY Prefiled pursuant to Article III, Section 2(A)(4)(b)(i) of the Constitution of Louisiana. AN ACT1 To authorize and provide relative to certain public property; to authorize and provide for a2 cooperative endeavor agreement for use of certain state property in Orleans Parish3 with the BioDistrict New Orleans; to authorize and provide for the transfer of certain4 state property; to provide for the transfer of state property in East Baton Rouge5 Parish; to provide for the property description; to provide for reservation of mineral6 rights; to provide terms, conditions, and requirements; to provide for an effective7 date; and to provide for related matters.8 Be it enacted by the Legislature of Louisiana:9 Section 1. The commissioner of administration shall have the authority to enter into10 a cooperative endeavor agreement with the BioDistrict New Orleans to allow the former11 Louisiana State Supreme Court site and the former state office building site located at 32512 Loyola Avenue, New Orleans, Louisiana, to be utilized as the new civil district court site.13 Section 2. The board of supervisors of Louisiana State University and Agricultural14 and Mechanical College, and the commissioner of administration, on behalf of the state,15 notwithstanding any other provision of law to the contrary, are hereby authorized,16 empowered, and directed to convey, transfer, assign, and deliver any interest, excluding17 mineral rights, the state may have to the former site of Earl K. Long Medical Center to the18 East Baton Rouge Parish Housing Authority, which property is further described as follows:19 A tract of land, with all the buildings and improvements thereon, situated in the20 Parish of East Baton Rouge, Louisiana, containing fourteen and 27/100 (14.27)21 acres, according to the survey of the northern portions of Lots Seven (7) , Eight (8),22 Nine (9), and Ten (10) of the KENNER TRACT, T-6-S, R-1-E, for Waldo S.23 Cockerham, said plat having been made by Charles A. February 15, 1956, a copy of which is attached to an act of sale with mortgage filed1 as Original 99, Bundle 3753, of the records of the Clerk and Recorder of East Baton2 Rouge Parish, Louisiana.3 Said tract is further described as being the remaining portion of a tract containing4 twenty (20) acres, said twenty (20) acres taken from the eastern portion of a tract of5 fifty (50) acres, said twenty (20) acres being comprised of Lots Seven (7), Eight (8),6 Nine (9), and Ten (10) of a subdivision of the MRS. E. KEENER TRACT, made by7 A. G. Mundinger, C.E. March 11, 1919, of record in Plan Book 1, Page 30 of the8 records of the Clerk and Recorder of said Parish, each of said lots containing five (5)9 acres, said tract of twenty (20) acres being subject to the following sales made10 therefrom:11 One and 8/100 (1.08) acres to Mrs Annie O. Guice in COB 464, Page 342.12 Two and 30/100 (2.30) acres to Home Oil Company in COB 464, Page 749.13 Two and 5.100 (2.05) acres to State of Louisiana in COB 405, Page 221.14 The above described property was acquired by the state by act of cash sale on15 September 26, 1963 and of record in COB 1728, Folio 455 of the conveyance16 records of the Clerk and Recorder of East Baton Rouge Parish.17 Section 3. The board of supervisors of Louisiana State University and Agricultural18 and Mechanical College and the commissioner of administration may convey the above19 property to the East Baton Rouge Parish Housing Authority, in exchange of consideration20 proportionate to the appraised value of the property. The board of supervisors of Louisiana21 State University and Agricultural and Mechanical College and the commissioner of22 administration are hereby authorized and directed to enter into such agreements, covenants,23 conditions, and stipulations and to execute such documents as necessary to properly24 effectuate any conveyanc e, transfer, assignment, or delivery of title, excluding mineral25 rights, to the property described in Section 2, and as more specifically described in any such26 agreements entered into and documents executed by and between the board of supervisors27 of Louisiana State University and Agricultural and Mechanical College and the28 commissioner of administration and the East Baton Rouge Parish Housing Authority, in29 exchange of consideration proportionate to at least the appraised value of the properties.30 SB NO. 154 ENROLLED Page 3 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. Section 4. The provisions of this Act shall supersede and control to the extent of any1 conflict with any other provision of law.2 Section 5. This Act shall become effective upon signature by the governor or, if not3 signed by the governor, upon expiration of the time for bills to become law without signature4 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.
