CONTROL DANGER SUBSTANCE. Provides relative to veterinarians and the Prescription Monitoring Program. (gov sig) AN ACT1 To amend and reenact R.S. 40:1013(C), to enact R.S. 40:1004(C), and to repeal R.S.2 40:1003(6)(e), 1005(A)(5) and (26), relative to veterinarians and the Prescription3 Monitoring Program; to provide for a veterinarian exception to the Prescription4 Monitoring Program; to remove the veterinarian exception for "dispenser"; to5 remove certain members from the Prescription Monitoring Program Advisory6 Council; to repeal certain provisions with respect to the levying and collecting of7 fees to veterinarians by the Louisiana Board of Pharmacy; and to provide for related8 matters.9 Be it enacted by the Legislature of Louisiana:10 Section 1. R.S. 40:1013(C) is hereby amended and reenacted and R.S. 40:1004(C)11 is hereby enacted to read as follows:12 §1004. Establishment of prescription monitoring program13 * * *14 C. Funding authority1 * * *2 C. The board shall have the authority to levy and collect an annual fee from3 each of the following practitioners in possession of authority to prescribe or dispense4 controlled dangerous substances: physicians, podiatrists, dentists, veterinarians,5 optometrists, advanced practice registered nurses, physician assistants, medical6 psychologists, or any other person subsequently authorized by law to prescribe7 controlled dangerous substances. The board shall also have the authority to levy and8 collect an annual fee from each pharmacy licensed by the board. The annual fee9 levied and collected from each person enumerated in this Subsection and each10 pharmacy shall not exceed twenty-five dollars.11 * * *12 Section 2. R.S. 40:1003(6)(e) and R.S.40:1005(A)(5) and (26) are hereby repealed.13 Section 3. This Act shall become effective upon signature by the governor or, if not14 signed by the governor, upon expiration of the time for bills to become law without signature15 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. DIGEST Thompson (SB 187) Present law provides for an exception as dispenser to a veterinarian who dispenses negligible amounts of controlled substances or drugs of concern as identified by rule. Proposed law amends present law to remove the dispenser exception for a veterinarian who dispenses negligible amounts of controlled substances or drugs of concern as identified by rule. Proposed law provides a veterinarian exception to the Prescription Monitoring Program. Present law includes the president of the Louisiana State Board of Veterinary Medicine and the president of the Louisiana Veterinary Medical Association as members of the Prescription Monitoring Program Advisory Council. Proposed law removes them from the council. Present law authorizes the Louisiana Board of Pharmacy to levy and collect an annual fee from veterinarians with the authority to prescribe or dispense controlled dangerous substances. Proposed law removes this authority. Effective upon signature of the governor or lapse of time for gubernatorial action.
