INSURANCE DEPARTMENT. Provides relative to a minority hiring survey by the division
of minority affairs in the Department of Insurance. (8/1/13)
AN ACT1
To amend and reenact R.S. 44:4.1(B)(11) and to enact R.S. 22:31(7), relative to the division2
of minority affairs; to authorize a survey relative to the hiring practices of insurance3
companies; to provide for applicability of public records exemptions to the survey;4
and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 22:31(7) is hereby enacted to read as follows:7
§31.  Division of minority affairs8
There is hereby created within the Department of Insurance a division of9
minority affairs which shall have the following functions and duties:10

(7) The division of minority affairs may conduct a survey of insurance12
companies doing business in Louisiana in order to seek information and data13
relative to the policies and practices of hiring of and contracting with14
minorities. The survey, data, and responses thereto shall not be a public record15
as defined by the Public Records Act, R.S. 44:1 et seq., and shall be exempt16

Section 2.  R.S. 44:4.1(B)(11) is hereby amended and reenacted to read as follows:1
§4.1.  Exceptions2

B. The legislature further recognizes that there exist exceptions, exemptions,4
and limitations to the laws pertaining to public records throughout the revised5
statutes and codes of this state. Therefore, the following exceptions, exemptions, and6
limitations are hereby continued in effect by incorporation into this Chapter by7
citation:8

DIGEST
Present law provides for a division of minority affairs within the Dept. of Insurance. The
division duties include assisting in the coordination of activities of the department's
Advisory Committee on Equal Opportunity.
Proposed law provides that the division of minority affairs may conduct a survey of the
hiring and contracting practices insurers use in relation to minorities. 
Proposed law further provides that the survey shall fall within the exception to the Public
Records Act.
