AN ACT1
To amend and reenact R.S. 22:1338(E), relative to homeowners' insurance; to provide with2
respect to the sunset provision in actions involving Chinese drywall; and to provide3
for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 22:1338(E) is hereby amended and reenacted to read as follows: 6
ยง1338. Homeowners' insurance; prohibited actions involving Chinese drywall;7

E. The provisions of this Section shall cease to be effective after July 1, 201310
2016.11
Section 2. This Act shall become effective on June 30, 2013.12

Present law prohibits an insurer from canceling or failing to renew any homeowners'
insurance policy based solely on the presence of installed Chinese drywall in the insured's
property or the filing of a claim by an insured that is based on the presence of Chinese SB NO. 34

drywall. Further provides penalties for any violation.
Present law sunsets after July 1, 2013.
Proposed law retains present law and changes the sunset date to July 1, 2016.
Effective June 30, 2013.
