AN ACT1 To enact Chapter 46-A of Title 46 of the Louisiana Revised Statutes of 1950, to be2 comprised of R.S. 46:2616 and 2617, relative to annual health action plans prepared3 by the Department of Health and Hospitals; to provide for a diabetes annual action4 plan; to provide for an obesity annual action plan; to provide for the preparation and5 submission requirements; to provide for the required content of the action plans; and6 to provide for related matters.7 Be it enacted by the Legislature of Louisiana:8 Section 1. Chapter 46-A of Title 46 of the Louisiana Revised Statutes of 1950,9 comprised of R.S. 46:2616 and 2617, is hereby enacted to read as follows:10 CHAPTER 46-A. HEALTH ACTION PLANS11 §2616. Diabetes annual action plan; submission; content12 The Department of Health and Hospitals shall submit an action plan,13 after consulting with and receiving comments from the medical director of each14 of its contracted Medicaid partners, to the Senate Committee on Health and15 Welfare and the House Committee on Health and Welfare no later than16 February first of each year on the following:17 (1) The financial impact and reach diabetes of all types is having on the18 state of Louisiana and its residents. Items in this assessment shall include the19 number of lives with diabetes covered by Medicaid through the Department of20 Health and Hospitals and its contracted partners, the number of lives with21 diabetes impacted by the prevention and diabetes control programs22 implemented by the department and its contracted partners, the financial cost23 diabetes and its complications places on the department and its contracted24 partners, and the financial cost diabetes and its complications places on the25 SB NO. 35 ENROLLED Page 2 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. department and its contracted partners in comparison to other chronic diseases1 and conditions.2 (2) An assessment of the benefits of implemented programs and activities3 aimed at controlling diabetes and preventing the disease.4 (3) A description of the level of coordination existing between the5 Department of Health and Hospitals, its contracted partners, and other6 stakeholders on activities, programmatic activities, and the level of7 communication on managing, treating, or preventing all forms of diabetes and8 its complications.9 (4) The development of a detailed action plan for battling diabetes with10 a range of actionable items. The plan shall identify proposed action steps to11 reduce the impact of diabetes, prediabetes, and related diabetes complications.12 The plan shall identify expected outcomes of the action steps proposed while13 establishing benchmarks for controlling and preventing diabetes.14 (5) The development of a detailed budget blueprint identifying needs,15 costs, and resources to implement the plan identified in Paragraph (4) of this16 Section.17 §2617. Obesity annual action plan; submission; content18 The Department of Health and Hospitals shall submit an action plan,19 after consulting with and receiving comments from the medical director of each20 of its contracted Medicaid partners, to the Senate Committee on Health and21 Welfare and the House Committee on Health and Welfare no later than22 February first of each year on the following:23 (1) The financial impact and reach obesity is having on the state of24 Louisiana and its residents. The plan shall identify proposed action steps to12 reduce the impact of obesity and related obesity complications. The plan shall13 identify expected outcomes of the action steps proposed while establishing14 benchmarks for controlling and preventing obesity.15 (5) The development of a detailed budget blueprint identifying needs,16 costs, and resources to implement the plan identified in Paragraph (4) of this17 Section.18 Section 2. This Act shall become effective upon signature by the governor or, if not19 signed by the governor, upon expiration of the time for bills to become law without signature20 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If21 vetoed by the governor and subsequently approved by the legislature, this Act shall become22 effective on the day following such approval.
