ENVIRONMENTAL HEALTH.  Requires public post secondary education institutions to
develop smoke-free policies for its campuses. (8/1/14)
AN ACT1
To enact R.S. 40:1300.263, relative to general smoking prohibitions on certain public post2
secondary education campuses; to provide for certain public post secondary3
education institutions developing smoke-free policies for its campuses; to provide4
for an effective date; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 40:1300.263 is hereby enacted to read as follows: 7
ยง1300.263. Development of smoke-free policies8
A. (1) Public post secondary education institutions shall develop smoke-9
free policies for its campuses.10
(2) For the purposes of this Section, "smoke-free" means the prohibition11
of smoking as defined in R.S. 40:1300.253(14).12
B. (1) Nothing in this Section shall prohibit a public post secondary13
education institution from developing a tobacco-free policy for its campus.14
(2) For the purposes of this Section, "tobacco-free" means the15
prohibition on the use of tobacco derived or containing products, including but16
not limited to cigarettes, cigars, cigarillos, pipes, hookah-smoked products, and17 SB NO. 36

oral tobacco products. 1
C. The provisions of this Section shall not supersede the provisions of2
R.S. 40:1300.256(A).3
Section 2. This Section shall become effective on August 1, 2014.4

Present law provides the general smoking prohibitions and exemptions.
Proposed law requires public post secondary education institutions to develop smoke-free
policies for its campuses and defines "smoke-free" to be the prohibition of smoking in
present law. 
Proposed law does not prohibit a public post secondary education institution from
developing a tobacco-free policy at its campus. Defines "tobacco-free" to mean the
prohibition on the use of tobacco derived or containing products, including but not limited
to cigarettes, cigars, cigarillos, pipes, hookah-smoked products, and oral tobacco products.
Proposed law does not supersede the general smoking prohibitions in present law.
Effective on August 1, 2014.
