Provides relative to distribution of certain monies as purses. (8/1/13) AN ACT1 To amend and reenact R.S. 4:183(B)(2), relative to horse racing; to provide for the2 distribution of certain monies as purses; and to provide for related matters.3 Be it enacted by the Legislature of Louisiana:4 Section 1. R.S. 4:183(B)(2) is hereby amended and reenacted to read as follows:5 ยง183. Contracts between licensees and permittees licensed to race horses at race6 meetings conducted in the state7 * * *8 B. Monies due as purses to persons licensed to race horses at race meetings9 conducted in the state as a result of conditions outlined in R.S. 4:183(A) and the10 monies due to the Horsemen's Benevolent and Protective Association pursuant to the11 provisions of R.S. 4:183(A)(4)(b) shall be allocated and distributed during the race12 meeting at which earned.13 * * *14 (2) In the event the amount distributed as purses to persons licensed to race15 horses at race meetings conducted in the state is less than the amount required by16 R.S. 4:183(A), and more than an amount equal to two times the average daily purse17 SB NO. 38 SLS 13RS-279 ORIGINAL Page 2 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. distribution at the race meeting at which generated, it shall be delivered to the1 Horsemen's Benevolent and Protective Association for further distribution to persons2 having earned monies during the meeting, in the direct proportion that the3 underpayment is to the monies earned by that person at that meeting. In the event the4 underpayment is less than an amount equal to two times the average daily purse5 distribution at that meeting, it shall be retained by the association in an interest6 bearing account to be used for purses at the next meeting conducted by that7 association. Interest earned on the account shall be added to the purse paid over and8 above the amount required to be paid as purses by R.S. 4:183(A).9 * * *10 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Michelle Ducharme. DIGEST Present law provides that monies due as purses to persons licensed to race horses at race meetings conducted in the state as a result of conditions provided by the law and the monies due to the Horsemen's Benevolent and Protective Association (HBPA) pursuant to law shall be allocated and distributed during the race meeting at which earned. Present law provides that if the amount distributed as purses to persons licensed to race horses at race meetings conducted in the state is less than the amount required by law, and more than an amount equal to the average daily purse distribution at the race meeting at which generated, it shall be delivered to the HBPA for further distribution to persons having earned monies during the meeting, in the direct proportion that the underpayment is to the monies earned by that person at the meeting. If the underpayment is less than an amount equal to the average daily purse distribution at that meeting, it shall be retained by the association in an interest bearing account to be used for purses at the next meeting conducted by that association. Proposed law changes the threshold amount to determine whether money is delivered to the HBPA or retained by the association conducting the meeting from more than amount equal to the average daily purse distribution at the race meeting at which generated to more than an amount equal to two times the average daily purse distribution at the race meeting at which generated.
