AN ACT1
To amend and reenact R.S. 14:62.4(A), relative to the crime of unauthorized entry of a place2
of business; to provide relative to the definition of the crime of unauthorized entry3
of a place of business; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 14:62.4(A) is hereby amended and reenacted to read as follows: 6
ยง62.4. Unauthorized entry of a place of business 7
A. Unauthorized entry of a place of business is the intentional entry by a8
person without authority into any structure or onto any premises, belonging to9
another, that is completely enclosed by any type of physical barrier that is at least six10
feet in height, or by a combination of any type of physical barrier that is at least11
six feet in height and a lake, river, bayou, or other body of water, and that is12
used in whole or in part as a place of business.13

Section 2. This Act shall become effective upon signature by the governor or, if not15
signed by the governor, upon expiration of the time for bills to become law without signature16
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If17 SB NO. 6

vetoed by the governor and subsequently approved by the legislature, this Act shall become1
effective on the day following such approval.2

Present law defines the crime of unauthorized entry of a place of business as the intentional
entry by a person, without authority, into any structure or onto any premises, belonging to
another and used in whole or in part as a place of business, that is completely enclosed by
any type of physical barrier that is at least six feet in height.
Proposed law retains present law and adds that the crime of unauthorized entry of a place of
business also includes the intentional entry by a person, without authority, into any structure
or onto any premises belonging to another and used in whole or in part as a place of
business, that is completely enclosed by a combination of any type of physical barrier that
is at least six feet in height and a lake, river, bayou, or other body of water.
Effective upon signature of the governor or lapse of time for gubernatorial action.
