SENATE CONCURRENT RESOLUTI ON NO. 119
BY SENATOR PERRY 
MOTOR VEHICLES. Establishes a task force to study and make recommendations on
implementation of the federal REAL ID Act of 2005 in Louisiana.
A CONCURRENT RESOLUTI ON1
To establish a task force to study and make recommendations relative to implementation of2
the federal REAL ID Act of 2005 in Louisiana.3
WHEREAS, Act No. 807 of the 2008 Regular Session of the Legislature directs the4
Department of Public Safety and Corrections to not implement the provisions of the federal5
REAL ID Act of 2005; and6
WHEREAS, Act No. 151 of the 2010 Regular Session of the Legislature directs the7
Department of Public Safety and Corrections to not implement the provisions of the federal8
PASS ID Act of 2009; and9
WHEREAS, House Bill No. 395 by Representative Guinn of the 2013 Regular10
Session of the Legislature, as amended, proposes to enact R.S. 32:412(M) and R.S.11
40:1321(M) to require the Department of Public Safety and Corrections, office of motor12
vehicles, to issue a driver's license or special identification card that bears a United States13
Department of Homeland Security approved security marking that reflects such credential,14
meets the standards of the REAL ID Act of 2005 upon request of any individual who is15
otherwise eligible to be issued a driver's license or special identification card as provided by16
law and who meets all the requirements of the United States Department of Homeland17
Security for a REAL ID Act compliant credential; and18 SCR NO. 119

WHEREAS, House Bill No. 395, as amended, further proposes to enact R.S.1
32:412(M) and R.S. 40:1321(M) to provide that if a Louisiana resident elects not to be2
issued a REAL ID Act compliant driver's license or special identification card, the3
Department of Public Safety and Corrections, office of motor vehicles, shall issue a driver's4
license or special identification card to any individual who is otherwise eligible to be issued5
a driver's license or special identification card as provided by law that indicates such driver's6
license or special identification card is not accepted by federal agencies for official purposes7
in compliance with the United States Department of Homeland Security rules and the words8
"Not for federal identification" shall be printed on the driver's license or special9
identification card.10
THEREFORE, BE IT RESOLVED that the Legislature of Louisiana establishes the11
Louisiana REAL ID Act of 2005 Task Force to study all issues and disputes related to12
implementation of the federal REAL ID Act of 2005, and to report its findings and13
recommendations on whether or not Louisiana should implement the federal REAL ID Act14
of 2005.15
BE IT FURTHER RESOLVED that the Louisiana REAL ID Act of 2005 Task Force16
shall be comprised of the following members:17
(1) The president of the Senate, or his designee.18
(2) The speaker of the House of Representatives, or his designee.19
(3) The chair of the Senate Committee on Transportation, Highways, and Public20
Works, or his designee.21
(4) The chair of the House Committee on Transportation, Highways, and Public22
Works, or his designee.23
(5) The deputy secretary of public safety services of the Department of Public Safety24
and Corrections, or his designee.25
(6) The commissioner of the office of motor vehicles of the Department of Public26
Safety and Corrections, or his designee.27
(7) Each member of the Louisiana congressional delegation or the member's28
designee.29
BE IT FURTHER RESOLVED that the members of this task force shall serve30 SCR NO. 119

without compensation, except per diem or expenses reimbursement to which they may be1
individually entitled as members of the organizations they represent.2
BE IT FURTHER RESOLVED that the president of the Senate or his designee shall3
act as chairman of the task force and the speaker of the House of Representatives or his4
designee shall act as vice chairman. 5
BE IT FURTHER RESOLVED that a majority of the total membership shall6
constitute a quorum of the task force and any official action by the task force shall require7
an affirmative vote of a majority of the quorum present and voting.8
BE IT FURTHER RESOLVED that the names of the members chosen or designated9
as provided herein shall be submitted to the chairman of the task force not later than August10
15, 2013, and that the chairman shall thereafter call the first meeting of the task force not11
later than September 15, 2013.12
BE IT FURTHER RESOLVED that the task force shall meet as necessary, shall13
submit a written report of its findings and recommendations to the chairmen of the Senate14
and House committees on transportation, highways, and public works not later than sixty15
days prior to the 2014 Regular Session of the Legislature, and shall terminate upon16
submission of its report.17
BE IT FURTHER RESOLVED that a copy of this Resolution shall be transmitted18
to the deputy secretary of public safety services of the Department of Public Safety and19
Corrections, the commissioner of the office of motor vehicles of the Department of Public20
Safety and Corrections, and each member of Louisiana's congressional delegation.21

Specifies that the members of the task force serve without compensation, except for such
reimbursement or per diem they are individually entitled to as members of the organization
they represent.  Names the Senate president or his designee as the chairman and the House
speaker or his designee as the vice chairman. Provides that the names of the members shall
be submitted to the chairman of the task force by August 15, 2013, and that the chairman
shall call the first meeting of the task force not later than September 15, 2013.
